BY U oMoimed by W City CounaM of ONY aBunynr. ufN : WHEREAS, the City of Bangor owns, operates and maintains the Bangor International Airport (BIA) as a public facility; and WHEREAS, BIA currently has lease agreements with motor vehicle ental companies under which said companies pay BIA a set percentage of their groes revenues as partial rent for the right to operate at BIA; and WHEREAS, other off -airport motor vehicle rental companies not leasing apace at BTA utilitxe BTA and benefit from the operation of BIA as a whole, including without limitation its roadways, taxiways, terminal and other BIA facilities, in carrying on their business activities at BIA; and WHEREAS, the City is entitled to reasonably regulate the business use of BIA, its roadways, property and buildings; perserve good order and peace at BIA and provide for the public health, safety, and welfare and to recover its costs from those who use, and benefit from BIA; and WHEREAS, the City wishes to impose a reasonable fee on these off -airport commercial rental car users which help defray the coat of providing and maintaining these public facilities; NOW, THEREFORE, be it ordained by the City Council of the City of Bangor, as follows: - TRAT, Chapter TI, Article 35 of the Laws and Ordinances of the City of Bangor be amended by adding the following: IN CITY COUNCIL November 27, 1995 First Reading CITY CLERK IN CITY COUNCIL December ll, 1995 Vote on Conflict fox Councilor Popper Vote 8 No 1 Abstained Councilors Voting No: Baldacci, Blanchette, Frankel, teen, Soucy. Councilors Voting No: Baldecci, Frankel 6 Popper Passed As Amended Amended by Deleting N2, In Section 6.4, 3(a) 96-38 ORDINANCE ( 'TITLE,) Amending Chapter 11, Article 35 of the Bangor LaAlrnorws andv Desertrainacee of the City ofnt EMMr l ✓� ..l 96-36 Sec. 6.9 O££ -airport motor vehicle rental businesses operating on the Bangor International Airport. 1. purpose. mhis section is enacted for the purpose of reasonably regulating the business use of public airport facilities by private motor vehicle rental companies which are located off airport property; preserving good order and peace at the airport; providing for the public health, safety, and welfare; helping to defray the costs of constructing, operatinge maintaining and improving the public airport facilities through the imposition of reasonable user fees; and regulating the use of public facilities in the furtherance of private commercial activities. 2. Definitions a. Airport Customer: Any person who arrives at the airport by aircraft and is transported from the airport to the location of an o££ -airport motor vehicle rental business in its courtesy vehicle. b. Courtesy Vehicle: A motor vehicle which carries licensee's airport customers to or from the airport. c. Off -airport Motor vehicle Rental Business: An individual, corporation, partnership, or other entity or person offering and providing to the public rental motor vehicles, including without limitation, automobiles and other four wheel passenger vehicles for hire, to be driven by the lessee. d. Licenseet An individual, corporation, partnership, or other entity or person operating at, entering on or exiting from airport property under a license issued by the City of Bangor pursuant to subsection 3 below. Licensee includes the officers, employees, agents o anyone acting on behalf of or with permission of Licensee. 3. License r vuired. No person engaging in an off -airport motor vehicle rental business shall operate at, enter upon or use airport property for the purpose of providing pickup or drop off service for airport customers except under an executed, written agreement with the City of Bangor specifically licensing the operation of such services at the airport. without limiting the authority granted elsewhere in this article, the 96-38 Airport Director is authorized to enter into o££ -airport business license agreements which authorize such licensees to conduct certain business operations onairport property i exchange for the payment of areasonable user fee Said agreement shall provide for the payment of annual user fees based upon a -percentage of the gross revenues from its airport customers, as follows: a. Effective January 1, 1996 through December 31, 2000 or the date upon which a licensee is granted to an off -airport motor vehicle rental business: 1. 58 on the gross revenues; and 2. 58 on the gross revenues for each of the six (6) months previous to the execution of a license agreement with any off -airport motor vehicle rental business operating upon airport property without awritten license agreement at the time of the enactment of this ordinance. b. Effective January 1, 2001 or the date upon which a license is granted to an off -airport motor vehicle rental business, whichever is later: 1. 7.58 of the groes revenues. 9. Rules and Reaulations. The Airport Director may issue such directives as may be necessary to implement this section, such directives to be issued pursuant to section 6.2. Licensees shall comply with all existing applicable airport rules and regulations, as they may be amended from time to time, including without limitation, mandatory minimum insurance requirements.
