On September 29, 1995, the City received a letter from Fred
Nichols, on behalf of Bangor Historic Track, Inc., indicating a
desire to extend the current Bangor Raceway Lease Agreement for an
additional one year term. Mr. Nichols' letter indicates that
Bangor Historic Track, Inc. will be seeking modifications to the
Agreement in connection with its renewal. Negotiations regarding
proposed changes to the Agreement will not be complete within the
95 day period provided in Article 3 of the Agreement. The attached
Council Order would extend the negotiation period for an additional
30 days.

OSDEMD,
THAT
WHEREAS, the terms of the current Bangor Raceway Lease Agreement
require that a Renewal Agreement be executed within 45 days of
receipt of written notice of an intent to renew said Agreement to
avoid termination of said Agreement; and
WHEREAS, said notice was received on September 29, 1995 and
additional time beyond the .November 13 negotiating deadline imposed
by the current Agreement is necessary to complete negotiations,
NOW,. THEREFORE) by the City Council of the City of Bangor:
ORDERED,
THAT the Bangor City Council hereby authorizes extension of the
Agreement renewal deadline to midnight, December 13, 1995 in order
to avoid automatic termination of the existing Agreement before
that time.

Dear Mike:
with this letter I would like to indicate our desire to
renew our "Lease Agreement" for the 1996 season.
1995 was not a satisfactory year in financial terms,
and we will definitely utilize the facilty substantially
fewertimes next year. We do, however, plan to continue
our facility improvement program which has to date
resulted in a more attractive, clean and functional venue
for all users.
we will be having a Directors' meeting the week of
October I6-20, at which time we will decide the racing
schedule for next year. Consequently, I would greatly
appreciate the opportunity to meet with you and the Bass
Park Committee to discuss the 1996 lease soon after
October 20. Primary issues to be addressed would include
utilization, improvements and rent.
