HomeMy WebLinkAbout1995-11-13 96-18 RESOLVECOUNCIL ACTION 96-18 Item No. Date November 13, 1995 Item/Subject: Approval of Resolution of Condemnation for Property In Bangor Located at 74-96 Main Street (Former Freese's Building) Responsible Department: Legal Commentary: The attached Resolve would give final municipal approval to a '•taking' of the former Freese's Building under provisions of the State's community development statute, 30-A MRSA S 5204. The "taking" is necessary to provide clear and marketable title i connection with Realty Resources Chartered's planned redevelopment of the rear third of the building into 34 units of low income elderly housing. Based on the City's prior acquisition of the Freese's Building by statutory foreclosure of FY 1993 tax liens, the attached Resolve would award $1.00 each in damages to Charles Fitzgerald and Bruce Slovin, the former fee owner and mortgage holder, respectively. S 5204 and the City of Bangor's Community Development Downtown Revitalisation Program, duly adopted andapproved by the Bangor City Council on October 13, 1982, the Bangor City Council, on October 23, 1995 as Council Resolve 95-443, adopted the attached Resolution of Condemnation affecting property located at 74-96 Main Street and further described in Book 3669, Page 1, Penobscot Registry of Deeds; and WHEREAS, Council Resolve 95-443 was served on the persona named therein On November 5 and 9, 1995, respectively; and wHRREAB, 30-A M.R.S.A. 5 5204 requires that after such service the Resolution is to be submitted to the legislative body of the municipality for approval or disapproval, NOW, THEREFORE, By the City Council of the City Of Bangor be it RESOLVED, THAT the Resolution of Condemnation relating to property known as the former Freese's Building and located at 74-96 Main Street adopted as Council Resolve 95-443 on October 23, 1995 is hereby approved. and be it further, RESOLVED, THAT the following amounts approved in Council Resolve 95-443 are hereby confirmed as the full amounts of just compensation payable to the individuals named; Charles Fitzgerald $1.00 Bruce Slavin $1.00 All others $1.00 96-18 The attached Resolve recites that copies of Council Resolve 95-443 have been served an Charles Fitzgerald and Bruce Slovin as required by 30-A MRSA 5 5204, with the date left blank. As of November 8, 1995, we had not received a return from Charles Fitzgerald. If w have not received a return by November 13, 1995t this item should be tabled to the Council's November 27th meeting.
