Rapaport, Bangor Hydro -Electric Company, and Fransway Realty Company, or their assignees, for Land on Washington and Oak Streets Responsible Department: Legal The attached Order would direct the City manager to terminate a Portion of two and all of one existing leases of City property. The attached Order would further direct the City manager to execute necessary documents to convey land and rights in land to the State of Maine. These parcels were originally identified by the Urban Renewal Authority and intended for highway and bridge purposes. This involves City property on Washington and Oak Streets affected by the construction of the new Bangor -Brewer Bridge. A Sketch of the affected property is also attached. BY the City Cou"ta of the CRY ofBanyon ORDERED, _ THAT WHEREAS, the City of Bangor is the owner of certain parcels of land designated as P&0 3, P&O 9and P&0 10 on the Disposition Plan, Bangor Urban Renewal, Renduskeag Stream Urban Renewal Project, dated February 6, 1968 and revised may 10, 1973; and WHEREAS, the City of Bangor has leased said parcels of land designated as P&O 3, P&O 9 and P&0 10 on said Disposition Plan; and WHEREAS, said leases provide that the City of Bangor may terminate said leases upon thirty (30) days written notice as to that Portion which may be necessary or desirable for highway or bridge purposes; and WHEREAS, the said parcels of land were designated by the Benduskeag Stream Urban Renewal Project as proposed future rights-of-way; and WHEREAS, the Maine Department of Transportation has determined that it is necessary to acquire land and rights in the parcels of land designated as 'Pao 3, P&0 9 and Pao 30 on said Disposition Plan, for highway or bridge purposes, NOW, THEREFORE, By the City Council of the City of Bangor, be it ORDERED, THAT the City Manager, acting for and on behalf of the Municipal Officers, be hereby directed to take all necessary and appropriate steps to terminate the leases affecting P&O 3, P&0 9 and P&O 10 on said Disposition Plan to the extent pensitted pursuant to the terms of said leases; and be it further - ORDERED, THAT the City Manager, acting for and on behalf of the Municipal Officers, is authorized to execute any and all documents necessary and appropriate to convey land and rights in land to the State of Maine in parcels designated by the Henduskeeg Stream Urban Renewal Project Plan as proposed future rights-of-way, upon payment of compensation by the State of Maine to the City of Bangor for the land or rights conveyed, in an amount to be approved by the Finance Committee.
