The water line will be installed from the corner of .the new AMG fence on Fuller Road to the new tower, said line to be run dawn the right hand side of the road heading towards the new tower. Due to time constraints, interim permission was given to the FAA in May to begin work on this element of its scheduled project pending formal Council approval. Said easement is given for the purposes stated in the Easement Deed referenced above. Councilman 95-374 'u Lf L oaM CITY OF BANGOR, a municipal corporation located in Penobscot County, State of Maine, as Grantor, for consideration paid, grants to the UNITED STATES OF ANCMICA,Newtingland Region, and through the FEDERAL AVIATION ADMINISTRATION, g 4 of Burlington, Massachusetts, a twenty foot (201) wide water line easement subject to the restrictions contained herein, in, over and across a portion of the parcel of land described in deed of United States of America to the City of Bangor, dated.Apri1 28, 1969 and recorded in Penobscot County Registry of Deeds in volume 2156, Page 450, said twenty foot wide water line easement lying ten feet (101) on either side of a center line described as follows: Beginning at a point on or near the property line of The United States Government and the City of Bangor, at Maine State Coordinates East zone (NAD 1927) N 357,297.98 and E 415,882.24, thence S 64039.58" W one hundred sixteen and sixty-five one hundredths (116.65) feet to an angle point; thence S 63001.05" W one hundred seventy and sixty-two one hundredths (170.62) feet to the beginning of a curve to the left; thence southwesterly, by and along a circular curve to the left with a radius of one hundred eighty-five and eighteen one hundredths (185.18) feet sixty-five and forty-six one hundredths (65.46) feet; thence S 42045.51^ W one hundred sixteen and eight tenths (116.8) feet to an angle point; thence S 45025.07^ W eighty-two and thirty-eight one hundredths (82.38) feet to an angle point; thence N 46058'08" W seventy-four and forty-six one hundredths (74.46) feet, more or less, to a new control tower. The easement herein granted shall consist of the right to enter onto the above-described easement area and onto adjacent land of the Grantor at all reasonable times with personnel, vehicles and equipment for the purpose of excavating for, installing, replacing, maintaining and using within the easement area a water line and. appurtenant structures thereto. The Grantor agrees, for itself and for its successors and assigns, that no trees, shrubs or buildings will be planted or constructed within ten (10) feet from the centerline of the water line easement as described above, but Grantor otherwise reserves the full use and enjoyment of its property. The Federal Aviation Administration, by acceptance and recording of this Easement Deed and of the rights and privileges hereby conveyed, agrees that after each entry upon said premises for the aforesaid purposes, it will promptly restore the surface of said premises to the same condition as prior to such entry. 95-374 -2- The said CITY OF BANGOR has caused this instrument to be Baled with its corporate seal, and signed in its corporate name by EDWARD A.
