Commentary:
The attached Charter Amendment would replace the current two consecutive term
limitation on memhership on the Superintending School Committee with a 12 -
year lifetime limit. After an individual has served for 12 complete years on
the Committee, that individual would no longer be eligible to be elected to
the School Comwittee in any subsequent election.
This recommended change hes come forward from the City Council's Charter
Comittee. It is closely related to a second proposed charter amendment
which would place a similar 12 -year llfetive limit on membership on the City
Council.
Manager's Comments,
AS noted, this change has been recommended by the Council's Charter
Comittee. I anticipate there will be some discussion on this Sten, and m
plan to schedule a workshop prior to the City Council meeting to review it.
Should the Council wish to proceed, a public hearing on this anendaent must
be scheduled. I would recommend that the hearing be set for the August 7,
1995, meeting.

THAT
wf¢RBAS, the Bangor City Charter currently does not impose term
limits on membership on the Superintending School Committee;
and
WHEREAS, the Charter does impose limitations on membership on the
City Council; and
WHEREAS, the existence of term limits ensures regular turnover of
elected officials with subsequent benefits including the
election of individuals with new ideas, approaches, and
abilities; and
WHEREAS, it is appropriate to establish consistent term
limitations on members of the City Council and
Superintending School Committee;
NOW, THEREFORE, By THE CITY COUNCIL OF THE CITY OF BANGOR, NR IT
ORDERED, THAT: the following amendment to Article II -A, Section
2, of the Bangor City Charter be placed on the ballot of the
next municipal election to be held on November ], 1995, for
approval by the qualified voters of the City Of Bangor in
accordance with Title 30-A, M.R.S.A. Sections 2106(1) and
2105:
Article II -A, Section 2, of the Bangor City Charter is hereby
amended by the addition of the following language:

ARTICLE II -A
SUPERINTENDING SCHOOL COMMITTEE
Sec. 2 Composition, Election, Tenure of Office
No person having served as a member of the Superintending
School Coomittee for complete or partial terms aggregating
twelve (12) complete years, consecutive or otherwise, shall
thereafter be eligible for election to a complete or partial
term as a member of the Superintending School Committee.
This amendment shall take effect on January 1, 1996, and be it
further ordered, that,
Pursuant to 30-A M.R.S.A. Sections 2104(6) and 2105(2), the form
of the question to be submitted to the voters shall be as
follows,
QUESTION
(CITY CHARTER AMENDMENT)
-Shall the proposed City Charter amendment summrised below be
approved and adopted by the City of Eangor2°
-Sym4gan The proposed amendment to Article II -A, Section 2, of
the City Charter would add a requirement that no person be
eligible to election to the Superintending School Committee after
they have served twelve complete years on the committee whether
or not those years were consecutive.'
The City Clerk is hereby directed to take all necessary action
consistent with this Order.
