HomeMy WebLinkAbout1995-07-24 95-341 ORDERCOUNCIL ACTION Date: .July 24, 1995 Item No. 95-341 Item/Subject: Order, Proposing Amendment to the Bangor City Charter, Article II, Section 2 -- Composition, Election, Tenure of Office, etc. Responsible Departeent: City Council The attached Charter Aeendeent would replace the correct two consecutive tare linitation on membership on the City Council with a 12 -year lifetime limit. After an individual has served for 12 complete years on the Council, that individual would no longer be eligible to be elected to the City Council in any subsequent election. This recounanded change has come forward from the City Council's Charter Counittee. It is closely related to a second proposed charter amendment which mold place a similar 12 -year lifetime limit an membership on the Superintending School Committee. Manager's Comments As noted, this change has been recommended by the Council's Charter Committee. I anticipate there will be some discussion on this item, and we plan to schedule a workshop prior to the City Council meeting to revlew It. Should the Council wish to proceed, a public hearing on this amendeent must be scheduled. I would recommend that the hearing beset for the August 91 1995, meeting. WHERM#T the Bangor City Charter currently imposes a limit of two complete consecutive terms as a member of the Bangor City Council; and WHEREAS, no limitations are placed o the total number of terms which an individual may serve; and WHEREAS, no term limits are placed on service on the Superintending School Committee; and WHEREAS, it is appropriate to establish consistent term limitations on members of the City Council and Superintending School Committee; NOW, THEREFORE, BY TBE CITY COUNCIL OF THE CITY OF BANGOR, BE IT ORDERED THATz the following amendment to Article II, Section 2 of the Bangor City Charter be placed on the ballot of the next regular municipal election to be held on November 7, 1995, for approval by the qualified voters of the City of Bangor in accordance with Title 30-A, H.R.S.A. Sections 2104(1) and 2105: ARTICLE II -CITY COUNCIL Sec. 2 etc There Shall be elected at large from the qualified voters in said city a City Council consisting of nine onshore. At the first election under the act there shell be elected nine members of said City Council. No voter shall vote for more than nine. The three candidates receiving the largest number of votes at said election shall hold of flee for three yeas, the three receiving the neon largest number of votes shall hold office for two years, the three receiving the next largest number of votes shall hold office for one year. Thereafter at each annual municipal election there shall be chosen at large three members of the City Council to hold office 95-361 for a term of three years. No voter shall vote for more than three. Each member of the City Council shall hold office until his successor is elected and qualified. Members of the City Council shall receive the a= of $400.00 per year in full compensation, the same payable quarterly, unless the City Council shall by ordinance increase the amount of such compensation. Provided, however, that no such ordinance increasing the Council's compensation shall take effect until approved by the voters at a public referendum and until three (3) years after the date of adaption by the Council. No member of the City Council shall, during the term for which he or she shall have been elected and for one year thereafter, be appointed to any other non -elected office of profit or employment position of the City. This amendment shall take effect on January 1, 1996. AND BE IT FURTHER ORDERED THAT: pursuant to 30-A M.R.S.A. Sections 2104(6) and 2105(2), the form of the question to be submitted to the voters shallbe as follows: QUESTION (CITY CHARTER AMBNplIIfNT) "Shall the proposed City Charter Amendment summarized below be approved and adopted by the City of Bangor?"
