AmA ed to .... ................ nnncilmsn 95-328 AGREEMENT BETWEEN THE BUREAU OF ALCOMOL, TOBACCO AND FIREARMS ME UNITED STATER ATTORNRY'E OFFICE AMD LOCAL, COUNTY, OR STATE LAW ENFORCEMENT AGENCIES FOR THE REINBURSEIffiNT OF OVERTIME EXPENSES This agreement is entered into by the Bangor Police Department, theBureauof Alcohol, Tobacco and Firearms (ATF) and the United States Attorney's Office, District of Maine, for the purpose of receiving reimbursable overtime costs incurred by the Bangor Police Department in providing resources to joint operations of the Eastern Maine Anti -Violent Crime Task Force. I. LIFE OF THIS AGREEMENT This agreement is effective on the date that it is signed by both parties and terminates at such time as an officer from the Bangor Police Department is no longer assigned to the Task Force. II. AUTHORITY This agreement is established pursuant to the provisions of the Department of Justice Anti -Violent Crime Award for the reimbursement of certain expenses of local, county or state lav enforcement agencies incurred while participants in joint operations/task forces. III. PURPOSE OF THIS AGRSEMENT This agreement establishes the procedures and responsibili- ties of the Bangor Police Department, the United States Attorney's Office, and ATF for the reimbursement ofcertain overtime expenses incurred. IV. EASE OF JOINT OPERATIOT LIGASE The name of this joint operation/task force is the Eastern Maine Anti -Violent Crime Task Force. Projected Dates of Operation: May 1995 - May 1996 or until grant funds are expanded. V. CONDITIONS AND PROCEDRRSS A.) To the maximum extent possible, the Bangor Police Department shall assign dedicated officer(s) to the joint operation/task force. Within ten (10) days of the effective 95-328 date of this agreement, the Bangor Police Department shall provide the United States Attorney's Office, through ATP, with the name(a), title(s) and employee identification number(s) of the officer(s) assigned to the Task Force. B.) The Bangor Police Department may request reimbursement for payment of overtime expenses directly related to work performed by its officer(s) assigned as member(s) of a joint operation/task force when such overtime is directly related to a case that meets the criteria for federal prosecution, and/or those cases with assigned ATF investigative case numbers. Overtime payments may not exceed $7,500 per year per officer, nor $625 per month per officer. C.) Overtime reimbursement requests submitted for the payment ofovertimeexpenses must be submitted on the desig- nated local, county and state law enforcement agency form, Reimbursement Request for Overtime Costs and Authorized Expenses. D.) The Bangor Police Department shall provide the United States Attorney's Office and ATF, within ten (10) days of the signing of this agreement, with the contact name, title, telephone number and address where the law enforcement agency wants the check for reimbursable overtime costs mailed. TheBangorPolice Department shall also provide to whom the check should be payable. E.) The Bangor Police Department will submit all overtime reimbursement requests for reimbursable payments, together with the appropriate documentation, to the Task Farce super- visor on a. monthly basis. F.) The Bangor Police Department will submit the request for reimbursement to the United States Attorney's Office, District of Maine, through the Resident Agent -in -Charge, ATF. G.) The Bangor Police Department shall certify that the request is for overtime expenses incurred by the Bangor Police Department for participation during the joint opera- tion/task force. The Bangor Police Department shall also certify that said request for reimbursement of overtime expenses has not been made to any other federal law enforce- ment agency. H.) The Bangor Police Department acknowledges that they remain fully responsible for their obligations as the em- ployer of the officer(s) assigned to the joint opera- tion/task force and are responsible for the payment of the ,q< 95-328 `t`Lr,1 overtime earnings, withholdings, insurance coverage and all other requirements by law, regulation, ordinance or contract regardless of the reimbursable overtime charges incurred. I.) All reimbursable hours of overtime work covered under this memorandum of understanding must be approved by the ATP first-line supervisor. J.) The maximum reimbursement entitlement for overtime worked on behalf of the Task Force cannot exceed $7,500 per officer assigned to the joint operation/task force period. VI. PAOOBAN AUDIT This agreement and its requirements are subject to audit by the United States Attorney's Office) the Department of Jus- tice; the General Accounting Office, and other government - designated auditors. The Bangor Police Department agrees to permit such audits and agrees to maintain all records relat- ing to these transactions for a period of not less than three (3) years and, if an audit is being conducted, until such time that the audit is officially completed. These audits include reviews of any and all records, docu- ments, reports, accounts, invoices, receipts o expenditures s relating to this agreement, a well as the interview of any and all personnel involved in these transactions. The revision(s) become effec- tive upon the date of approval.
