Commentary
This Order would authorize the execution of an attorneys fee
agreement with Amerling E Burns, P.A., which will be prosecuting a
City claim against Leo A. Daly Company in
connection with the
additions to Bangor international Airport. The terms of the
agreement are protected from mandatory disclosure under Maine's
Freedom of Access statute, and the attached Order would preserve
that confidentiality until after trial or settlement of the City's
lawsuit against Daly.

ORDERED,
TEAT Edward A. Barrett, City Manager, is hereby authorized
to execute a fee agreement with the law firm of Amerling n Burns,
P.A., of Portland, for the provision of legal services and legal
representation of the City of Bangor in connection with claims
against Leo A. Daly Company, as designer of an addition and
novation project at Bangor International Airport.
The original of said agreement shall remain on file
n the City Solicitor's office. Pursuant to 1 MRSA S 402(3)(B) and
Rule 502 Of the Maine Rules of Evidence, said agreement and its
terms shall be deemed confidential and not subject to public
disclosure until final resolution of the City of Bangor's claims
against Leo A. Daly Company.
