Statement of Pact: The attached "Supplemental Agreement No. 1" provides a restated boundary description for certain land located at Bangor International Airport adjacent to the Maine Air National Guard/101st Air Refueling Wing air base. The land concerned is currently leased by the United States of America, through the Army Corps of Engineers, from the City of Bangor, for use by the Maine Air National Guard, under a 50 year land lease dated February 6, 1984. The attached "Supplemental Agreement No. V provides a more accurate boundary description of the leased parcel and adds certain access drives and rights-of-way to the land currently leased. The wised description also includestwoadditional parcels that have been added to the leased property since 1964, by prior amendments to the original Lease. Other than the revised description,all other provisions of the 1984 Lease, as previously amended, remain unchanged. Councilman 95-254 DEPARTMENT OF THE ARMY CORPS OF ENGINEERS U.S. ARMY ENGINEER DISTRICT, NEW YORK SUPPLEMENTAL AGREEMENT NO. 1 Lease No. DACASI-5-86-195 THIS SUPPLEMENTAL AGREEMENT NO. 1 to Lease No. DACA51-5-86- 195 (hereinafter called the 'Lease") is made and entered into this day of , 1994 by and between the CITY OF BANGOR, hereinafter called the LESSOR, and the UNITED STATES OF AMERICA, hereinafter called the GOVERNMENT. WITNESSETH: WHEREAS, by lease dated April 25, 1986, the Lessor leased to the Government approximately 86.61 acres of land, more o lees (hereinafter called "the Premises"), situated at Bangor International Airport, in the City of Bangor, Penobscot County, Maine for the term beginning February 6, 1984 through December 31, 2034, with provision for an optional additional lease term of 50 years, as more particularly set forth in the Lease; and WHEREAS, the parties hereto wish to amend the Lease to provide for a more accurate description and depiction of the Premises. NOW THEREFORE, in consideration of the mutual benefits to be derived hereunder, the parties hereto do hereby amend the Lease in the following respects and in these respects only: The words -A certain parcel of land, together with any improvements thereon, consisting of 86.61 acres, more or less, as shown in part on a survey entitled "B.I.A. Commercial Industrial Park - Lotting Plan", by John T. Frawley City Engineer, dated June 7, 1976 and more particularly described in Exhibit "A", attached hereto and made a part hereof." are deleted from Paragraph 2 of the Lease, and the words "A certain parcel of land, together with any improvements thereon, consisting of 89.07 acres, more or less, as described in Exhibit "A-111, attached hereto and made a part hereof, and as depicted in Exhibit "B-1" (an Army Corps of Engineers Project Map based on a merger of the HRA OEST ASSOCIATES, INC. Map entitled "Standard Boundary Survey land to be acquired Bangor, Maine", dated March 1990, revised Sept. 1992 sheet 1 of 1, which is in the Maine State Grid Coordinate System East Zone "NAD 83" and the Andrew J. Shyka map entitled "Standard Boundary Survey Air National Guard - Bangor, Maine" dated Nov. 7, 1986, revised Jan. 5, 1986, 95-256 sheets 1 to 3, which is in the Maine State Coordinate System East Zone "NAD 2711, attached hereto and made a part hereof." are inserted in lieu thereof. it is understood and agreed by and between the parties hereto that all other terms and conditions of the aforementioned Lease No. DACA51-5-86-195, except asmended by this Supplemental Agreement No. 1, shall be and remain the same. The merger of ownership and dissolution of an FAA Easement Right -of Way called "The Old puller Road" in its original configuration recorded on Book 3428 Page 257 and its configuration as used; f. Close the current DACA51-5-86-195 leased -property line which is depicted in the Shyka Survey as being parallel to and 40 - feet northeasterly from the existing edge of pavement of Taxiway "A", to within 12.5 feet of the Shyka Survey depicted existing edge of pavemeppt. The purpose of this action is to provide continuity of Kited States Government real estate interest up to and abutting the northeasterly edge of Taxiway "A" pavement, which according to the Bangor International Airport Master Plan, prepared November, 1989, by Hoyle, Tanner A Associates will, when implemented, effectively expand the northeastern sideline of the Taxiway "A^ pavement from its existing position, as Shown in the Andrew L. Shyka Survey, 12.5 feet northeasterly and parallel along its length, from its depicted ALS survey location containing 2.061 acres; g. Building 485, Entry Traffic Check House includes the area of an eighty foot right-of-way (Maineiac Avenue) extending from Griffin Road West to the ANG property line containing 0.88 acres; h. Parcel E-1 as depicted on the Maine Air National Guard - Standard Boundary Survey - land to be acquired, as prepared by A-7 95-254 HTA-GEST Associates, dated originally in March 1990 containing 8.05 acres. i. A 0.505 -acre "Shyka Cross -Hatched Area, portion of the so-called KC -135 heavy duty ramp whose previous Lease No. DACA512- 5-76-350 by the Maine Air National Guard from the City of Bangor was signed 30 November 1985 and would have expired 30 November 1995. Said "Shyka Cross -Hatched Area" is described as having a common boundary with, and running in a northeasterly direction 367.49 feet consistent with the southeast border of the said "Fire Station Parcel", described below, thence from the most easterly corner of "Fire station Parcel",60 feet southeast to a point (123) ALS in corner Of "Fire Station Parcel", thence 366.70 feet, southwesterly to a point (124) ALS, thence 60 feet northwesterly, to the Point of Beginning. Meaning and intending to merge this exclusive 0.505 acre portion of the KC -135 heavy duty ramp lease into the herein lease. said parcel herein described, encompasses within its boundaries but does not include within its lease area the following parcels: a. A prior United States Govemment-acquired fee owned interior parcel identified Parcel 3 or "Fire Station Parcel" upon which Building 512, the Fire Station is located. The premises are described in a deed from Gladys K. Carleton (a/k/a the Gladys Smith Carleton) to the United States Goverment by deed dated 29 March 1956 recorded in Book 1526, Pages 153 ad 154 in said Penobscot County Registry of Deeds. This lot was excluded by United States of America for Air National Guard purposes and was not part of the description of excess Dow Air Force base property that the Government deeded to the City of Bangor at Book 2156 Page 449. Said parcel consists of approximately 2.90 acres and was not included in the original area covered in lease described herein of DACA51-5-86-195. b. A prior Government -acquired fee -owned interior parcel formerly identified as lot No. 19 and Lot No. 20 of the City Subdivision entitled -B.I A. Commercial - Industrial Park" recorded in said Penobscot County Registry of Deeds in a Plan file D 626-76. Said interior parcel was transferred by the City of Bangor to the Government for the OTH-B Rider system for purposes of constructing a commissary and physical fitness facility by the City of Bangor by Quit Claim Deed dated 20 June 1985 recorded in said registry in Book 3677 Page 67, consisting of approximately 8.15 acres. Said 8.15 acres were not included in the original area covered in lease No. DACA51-5-86-195 described herein. c. A prior United States Government acquired fee owned interior parcel identified as Parcel 1 or "pO1 Pumphouse 4522)". This lot was excluded by the United St tea of Americafor Air National Guard purposes and was not part of the description of excess Dow Air Force Base property that the Government deeded to the City of Bangor at Book 2156 Page 449. Said parcel consisits ou A-8 95-256 of approximately 0.04 acres and was not included in the area covered in lease described hereinOACA51-5-86-195.
