HomeMy WebLinkAbout1995-04-24 95-190 ORDINANCECOUNCIL ACTION Item No. 95-190 Date April 24, 1995 Item/Subject: Amending Chapter II, Article 13, Section 5 of the Laws and Ordinances of the City of Bangor -- Police Department Responsible Department: Legal Commentary: Council Ordinance $94-459 passed November 14, 1994 contained a citation error. The purpose of this Ordinance amendment is to correct that error to avoid any question of Bangor police officers' eztrajurisdictional authority. For this same reason, it is requested that second reading be waived and that the Ordinance amendment be enacted as an emergency to be effective upon enactment by the Council. The Municipal Operations Committee discussed this matter at its April 18, 1995 meeting. Be it ordaikd Ey the City Casull of the City of Bangor, w fUhmor WHEREAS, Council Ordinance A94-459 w acted by this Council on November 14, 1994 substantially a ending the Laws and Ordinances of the City of Bangor relating to the operation, duties and authority of the Bangor Police Department; and WHEREAS, said Council Ordinance q94-459 contained a statutory citation arror in Subsection 5.1 of Section 5, Article 13, Chapter II (AxxestJurisdiction); and WHEREAS, said citation error could adversely affect the legality of certain extra jurisdictional on duty activities of Bangor Police Officers including potential adverse impacts on criminal investigations; and WHEREAS, immediate amendment and enactment is necessary to correct said citation error and to ameliorate any Possible adverse impacts; and WHEREAS, the City Council finds and declares that the effective date of an amendment to correct said citation error should be the date of enactment of said amendment and that such an effective date is immediately necessary to preserve the public peace, health and safety; NOW, THEREFORE, be it ordained by the City Council of the City of Bangor, as follows: 9s-190 TNAT Chapter II, Article 13, section 5, subsection 5.1 be amended to read, as follows: 5.1 Arrest Jurisdiction. In addition to any other powers of arrest authorized by state and federal statutes, all Police Officers of the City of Bangor are authorized to make arrests under the provisions of 30-A We 9 405 2671@ -AI as amended, when they are on duty.
