have been in intermittent discussions over the past year with Kevin
P. Mahaney of Bangor, concerning a possible donation of one or
parcels of land owned byMr hn
Maaey off Hayford Road and Hayford

Road extension, located adjacent or in close proximity to the
Sawyer Ice Arena at Hayford Park. During the current year, Mr.
Mahaney has proposed to donate a portion of City Tax Map 22, Lot
12E, containing approximately 17,000 square feet. Council approval
is requested at the Council's December 28th meeting, in order to
qualify the gift as a 1994 federal income tax itemized deduction.

ORDERED,
THAT the City Manager is hereby authorized and
directed, on behalf of the City of Bangor, to accept a proposed
gift of a 114 x 111 foot parcel of land locatedtothe rear of 101
West Broadway and fronting on an extension of Hayford Road from
Kevin P. Mahaney. The City Manager shall accept said gift upon
execution and delivery by the donor of a deed to the City of Bangor
in the form attached to this Order.

Kevin Mahaney is offering to make a gift to the city of Bangor of
a portion of his land on Hayford Road. He would like to make the
gift before December 31, 1994.
The land is a portion of not 12E on Tax Map 22, in the rear of
101 West Broadway, with approximately 120 feet of frontage on the
extension of Hayford Road.
I am enclosing a copy of the proposed deed to the City and a
portion of a survey plan on which I have highlighted the land
proposed for conveyance.
I understand that this offer will be considered by the city
Council at the meeting on December 28, 1994.

RELEASE DEED DRAFT
KEVIN P. MARANEY of Bangor, Penobscot county, Maine, as
a gift, releases to the CITY OF BANGOR, a body corporate located
at Bangor, Penobscot County, Maine, the land in Bangor, Penobscot
County, Maine, described in Schedule A attached.
The Grantee's mailing address is 73 Harlow Street,
Bangor, Maine 04401.

Land in Bangor, Penobscot county, Maine, described as follower
A certain lot or parcel of land situated on the
southwesterly side of Hayford Road, so called, in the
City of Bangor, County of Penobscot, State of Maine and
being more particularly described as follows:
Beginning at a point on the southwesterly sideline of
said Hayford Road, so called, which point is further
described as,being 177.57 feet as measured on a course
of (N 390 37. 00" W) by and along the southwesterly
sideline of said Hayford Road from an iron bolt found
at a point defined by the intersection of the
northwesterly sideline of said West Broadway with the
southwesterly sideline of Hayford Road, so called;
thence (N 390 37. 00" w) by and along the southwesterly
sideline of said Hayford Road, a distance of 157.26
feet to an iron rod set an said sideline, which point
s further described as being the most easterly corner
of land now or formerly of Sarah 0. Mahaney as
described in a deed recorded at the Penobscot Registry
of Deeds in Volume 4489, Page 52;
thence (S 500 23. 00" W) by and along the southeasterly
line of land of said Sarah 0. Mahaney, a distance of
114.00 feet to an iron rod set at a corner of land of
said Sarah 0. Mahaney;
thence (S 400 41' 38" E) by and along the northeasterly
line of land now or formerly of Charles J. Cronin and
Anne L. Cronin as described in a deed recorded at
Penobscot Registry of Deeds in Volume 1800, Page 277, a
distance of 86.84 feet to a point on said line of
Cronin;
thence (N 50° 19 02" E) a distance of 111.04 feet to
the point of beginning.
Bearings referenced herein are calculated from a traverse
oriented to magnetic north in the month of August, 1989, which
traverse was established by Plisga 6 Day, Land Surveyors, for a
survey of the premises herein described.
The above described lot or parcel of land containing 17,702
square feet, more or less, is a portion of the premises conveyed
by deed da;ed February 26, 1993, from Christopher Conley and
Katharine Conley to Kevin Mahaney, recorded in the Penobscot
County Registry of Deeds in Book 5277, Page 170, and is subject
to the same conditions, restrictions, obligations and easements
referred to therein.

EXCEPTING AND RESERVING a certain lot Or parcel Of land described
s follows in the deed from Kevin P. Mahaney to John Supranovich,
Jr. and Paulette A. Winchester, dated December 1994, to be
recorded in Penobscot County Registry of Deeds:
'Beginning at a point on the southwesterly sideline of said
Hayford Road, so called, which point is further described
as,being 177.57 feet as measured on a course of (N 390 37'
00" W) by and along the southwesterly sideline of said
Hayford Road from aniron bolt found at a point defined by
the intersection of the northwesterly sideline of said West
Broadway with the southwesterly sideline of Hayford Road, a
called, said point of beginning also being the northwesterly
corner of land described in the deed from Kevin P. Mahaney
to John Supranovich, Jr. and Paulette A. Winchester dated
October 40 1993 and recorded in Penobscot County Registry in
Book 3447, Page 323;
thence (N 390 37• 00° W) by and along the southwesterly
sideline of said Hayford Road, a distance of 37.00 feet to
Point on said sideline;
thence (S 50° 19' 02" W) to a point on the northeasterly
line of land now or formerly of Charles J. Cronin and Anne
L. Cronin, as described in a deed recorded in Penobscot
county Registry of Deeds in volume 1800, Page 277;
thence (S 40' 41' 38" E) by and along the northeasterly line
of land of said Cronin to the southwesterly corner of said
land conveyed by Kevin P. Mahaney to Supranovich and
Winchester, as described in Book 5447, Page 323)
'thence (N 500 19. 02" E) along the westerly line of said
land conveyed to Supranovich and Winchester to the point of
beginning.
Meaning and intending t0 Convey a strip of land 37 feet wide
adjoining the rear line of land described in said deed from
Mahaney to Supranovich and Winchester recorded in Book 5447,
Page 323, together with the garage located thereon."
ALSO RELEASING to the Grantee as appurtenant to the premises
herein conveyed, an easement for all purposes of a way, in common
with the Grantor and others who now have or may hereafter acquire
rights therein, over Hayford Road (formerly known as Orange
Street) to the extent not accepted as a public way by the City of
Bangor, for a distance.of 334.83 feet from the westerly line of
West Broadway.
For Grantor's source of title reference is also made to the deed
from Kevin P. Mahaney to Sarah O. Mahaney dated March 3, 1993,
recorded in Book 5277, Page 172, and the deed from Sarah O.
Mahaney to Kevin P. Mahaney dated August 26, 1994, and recorded
in said Registry in Book 573a, Page 103.
