Commentary:
The properties at Ito, 65V. & 34 Smith Street were Purchased by
Bangor Savings Bank from William Thompson in December,1992. (Deed
V524113293, effective 4/1/93, FY '94). The deed included transfer of
ownership on the three Percale. Due to oversight, only 34 Smith
Street was transferred to Bangor Savings Bank which created an
incorrect assessment
ssment against William Thompson on 15V (95732) and 65V
(63371) SmithStreet.
State statutes empowers the Assessor either upon written request
filed within 185 days from commitment date or on their own
initiative within one year from commitment, may make an abatement to
correct any illegality, error
regularity. in assessment. In
either case, the time hasexpired.
However, the Municipal Officers either upon written application after
e year but within 3 years from commitment or on their o
initiative may make an abatement to correct any illegality, error or
irregularity in assessment.

WARRANTY DEED
95-444
William E. Thompson, Jr., of Brunswick, Maine, for consideration paid, grants
to Bangor Savings Bank, a Maine corporation having a place of business in Bangor,
Maine, with warranty covenants, certain lots or parcels of land, together with the
buildings thereon, in Bangor, Penobscot County, Maine, bounded and described as
follows:
PARCEL ONE: Beginning at an iron bolt on the westerly line of Smith
Street, one hundred fourteen and ]5/100 feet southerly on said westerly
line from a granite monument at an angle in said westerly line; thence
North eighty-one degrees West on Me southerly line of the lot of land
conveyed by Arthur S. Haskell, one hundred eleven and 8/10 feet to an
iron bolt on the southeasterly line of a passageway as laid down on the
plan of said lots on Smith Street and recorded in the Penobscot County
Registry of Deeds in Plan Book 6, Page 16; thence southeasterly and
southerly on the line of said passageway twenty-nine feet to an iron bolt
at the northwesterly corner of the lot of land conveyed by said Haskell
to Rose Denaco; thence easterly on the northerly line of the lot conveyed
by said Haskell to said Denson, Marty -two feet to an iron bolt at Me
northeasterly corner thereof; thence southerly on the easterly line of said
lot as conveyed by said Haskell to said Denson, sixteen feat to an iron
bolt on the northerly line of lot numbered eleven on the plan of said lots
on Smith Street; thence easterly on Me northerly line of said lot
numbered eleven, sixty-one and 5/10 feet to an iron bolt on the westerly
line of said Smith Street; thence northerly on the westerly line of said
Smith Street, forty-Mree and 25/100 feet to Me bounds begun at; being
the southerly part of Lot numbered ten and a small triangular piece from
the southwesterly corner of lot numbered nine. Also, a strap situated on
the easterly side of said Smith Street, being twenty-five feet in width
and lying within Me range of the northerly and southerly lines of the
above-described lots, and being in Me marginal lots, as dedicated by plan
of said lots on Smith Street. Reserving however, from the last described
parcel of land, that part of a twelve foot right of way extending from
Valley Avenue to said Smith Street, as is shown on said plan of lots,
which crosses said lot
PARCEL TWO: Lot 1: Beginning at a point six feet from Smith Street,
so-called, on the northeasterly line of land owned or formerly owned by
G. H. Emerson; thence running westerly ninety-four feet, more or less,
on Me line of the G. H. Emerson property, to a passageway; thence
northerly sixty feet on the line .of said passageway; thence easterly
ninety-four feet, more or less; thence southerly sixty feet on a line
parallel with Smith Street, so-called, to the place of beginning; being lot
numbered eleven as laid down on Plan Book No. 6, Page 16, recorded
in the Penobscot County Registry of Deeds; reserving from Lot No. 11-
a strip of land six feet in width and sixty feet in length on Smith Street,
so-called, said strip of land to be used as a sidewalk.
Lot 2: Also a certain parcel of land situate in said Bangor, between Ohio
Street and Smith Street thus bounded: Beginning at the southwesterly
corner of Lot No. Ten (10) as shown on the plan recorded in the
Penobscot County Registry of Deeds in Plan Book No. 6, Page 16,
referred to, and on the easterly sideline of the passageway referred to
and appearing upon said plan; thence in a northerly direction on said line
of said passageway, sixteen feet to a bolt driven into the ground; thence
in an easterly direction and parallel to the southerly side line of said Lot
No. 10, thirty-two feet to an iron bolt driven into the ground; thence at
right angles in a southerly direction, sixteen feat to an iron bolt driven
into the ground in said southerly sideline of said Lot No. 10; thence in a
westerly direction on and by said sideline of Lot No. 10, thirty-two feet
to Me point begun at, where there is also an iron bolt driven into Me
ground. This conveyance is subject to any sewer line which may cross
the above described second parcel.
Excepting and reserving from Me above described premises, a parcel
conveyed to Theresa E. Davis and Timothy B. Davis, bounded and
described as follows:
Beginning at a point on the generally southeasterly sideline of Smith
Street Avenue at the intersection of lots 31 and 30 as shown on a plan
recorded in the Penobscot County Registry of Deeds in Plan Book 6,
Page 16; thence in a generally southeasterly direction, along the dividing
line between said lots 31 and 30, thirty-seven (37) feet to a point;
thence in a generally northeasterly direction and parallel to said Smith
Street Avenue, nineteen 09) feet to a point; thence in a generally
northwesterly direction and parallel to the dividing line between lots 31
and 30 to the southeasterly line of Smith Street; thence in a generally
westerly direction along Smith Street to Me point of beginning.
For the Grantor's source of title reference may be had to the deed from
Kathleen E. Allan to William E. Thompson, Jr., dated November 23,
1990, and recorded in the Penobscot County Registry of Deeds in
Volume 4766, Page 225.
This deed is an absolute conveyance of title in effect, as well as in form,
and is not intended as a mortgage, trust conveyance or security of any
kind. The consideration for this deed Is full release of all debts, notes,
obligations, costs and charges by the terms of two mortgages on Me
above described property, given by William E. Thompson, Jr. to Bangor
Savings Bank, dated November 23, 1990, and recorded in the Penobscot
County Registry of Deeds in Volume 4756, Page 228, and Volume
4777, Page. 37.
