Item/Subject: Amending Chapter IV, Article 2 of the Laws and
Ordinances of the City of Bangor -- Licenses and Permits

The attached Council Ordinance would ameM our current business
licensing provisions to prohibit the issuance or renewal of
business licenses and permits to individuals or corporations who
are in a delinquent status on taxes and other obligations owed to
the City. Currently, the ordinance denies licenses, permits and
renewals only where the applicant is in a delinquent status with
respect to taxes or other obligations incurred at the premises
shown in the application. The amendment will aid City staff in our
collection of delinquent City accounts. Your approval is
recommended.

THAT Chapter IV, Article 2 of the Laws and Ordinances of the City
of Bangor is hereby amended in Section 5(C), as follows:
"Sec. 5 Licensing Standards and Criteria.
(C) that the applicant has paid all real
estate and personal property taxes, aeve r
user fees and other debts owed to the

A license or permit application shall not
be denied under subsection (c) above
where the applicant is a business with
respect to which collection actions have
been stayed or the underlying debt has
been discharged by order of the United
States Bankruptcy Court, or where the
underlying debt is the subject of a
authorized, current workout agreement
executed by the applicant and the City
€ginance 9pirector or City
€Treasurer/£Tax Collector. Workout

agreements for this purpose must provide
for payment in full of the underlying
debt and all interest and other charges
assessing accruing thereon within 18
months or less from the agreement date.
On request, the City €finance Director
shall certify the existence and current
status of any such workout agreement to
the applicant and to the City eClerk.
Except in bankruptcy cases, any license
or permit issued on the baste of a
workout agreement shall be revoked by tk
City Clerk upon certification by the City,
Finance Director that thelicense Or
permit holder has failed to meet its
obligations under the workout agreement
concerned.'
