HomeMy WebLinkAbout1994-12-12 95-28 RESOLVECOUNCIL ACTION Item No. 95-28 Date December 12, 1994 Item/Subject: Ratifying the Police Chief's Execution of a Letter Agreesent with the Penobscot Job Corps Center Responsible Department: Lagal For approximately the last eight years, the Job Corps has offered to reimburse the City for the costs of backup police support, as well as taking responsibility for federal or state workers' compensation protections to responding officers, specifically requested by the Job Corps in certain situations. This has been in addition to reimbursement for 20 hours of assigned police coverage at the Job Corps site. This understanding has operated pursuant to Letter Agreements between the Job Corps and the Police Department. Chief Harriman has executed the most recent Letter Agreement. He has requested ratification of this action. Approval of future Letter Agreements will require annual Council action. The Job Corps has honored their obligations in the past concerning these .issues. Your approval is recwmuended. Department Head Manager's Comments: Q City Manager Associated Information: Resolve, Letter Agreement Finance Director Legal Approval: Legal has reviewed this Letter Agreement and is satisfied with its contents. n City So/1Cfty cito�W4 Introduced For 0-003 'F- % Passage First Reading Referral Page 1 of 3 Assigned to Councilor Cohen December 12, 1994 95-29 CITY OF BANGOR (TITLE.) �60hleg.------ Ratifying the P61ice-- Chief's --Exacvtxon of ------ Letter Agreement with the Penobscot Job Coiys Center By W Cly Cow,it ane My ofBange.- BBSOLVBD, WHEREAS, the Bangor Police Department currently provides 20 hours of assigned police coverage to the Penobscot Job Corps Center as authorized by Council Order No. 94-36; and WHEREAS, said police coverage, as well as coverage at other times, may at times be supplemented by additional police officers; and WHEREAS, the Penobscot Job Corps Center has specifically requested in the past, and may request in the future, backup police coverage In certain situations; and WHEREAS, the Penobscot Job Corps Center has entered into Letter Agreements in the past whereby they agree to reimtmrse the City for the costs of backup police support specifically requested by the Penobscot Job Corps Center and provide certain federal and state workers' compensation protections to responding police officers; and WHEREAS, the Penobscot Job Corps Center has tendered a Letter Agreement in substantially similar form to past Letter Agreements for execution retroactive to October 1, 1994; and WHEREAS, Police Chief Randy Harriman has executed said Letter Agreement on behalf of the Bangor Police Department, NOW, THEREFORE, by the City Council of the City of Bangor be it RESOLVED THAT the action of Police Chief Randy Harriman in executing a Letter Agreement, a copy of which is attached hereto, on behalf of the Bangor Police Department with the Penobscot Job Corps Center for the period October 1, 1994 through and including September 30, 1995 is hereby ratified. The Penobscot Job Corps Center understands that the Bangor Police Department has police powers which it may exercise within the bounds of the Job Corps site at the Union StreetCampus. The Penobscot Job Corps Center requests that, in the event that the Center has a need for the exercise of police powers within the campus, relating to Penobscot Job Corps Center property or personnel and the extent that the Bangor Police Department and other resources available to the Center need support for the control of the situation, the Bangor Police Department, located at 35 Court Street, Bangor, Maine, will render backup support to assist in the control and resolution of the situation to the extent its personnel and other resources reasonably permit. The costs attributed to such backup support rendered by the Bangor Police Department for the benefit of the Penobscot Job Corps Center, specifically requested by the Center, will be reimbursed by the Penobscot Job Corps Center and any individual who renders such services will be entitled to protection of the Federal Employees Compensation Act, adjusted to reflect the benefits payable under the State of Maine Compensation Legislation. This agreement will be in effect from October 1, 1994 to September 30, 1995. Please sign and return a copy of this letter so that our files reflect our agreement.
