Ordinances of the City of Bangor (Use of Public Sewers and Drains)

TEAT Chapter v, Article 9 of the Laws and Ordinances of the City of
Bangor (Use of Sewers and Drains) is hereby amended by the addition
of sections 3.3 and 3.4, as follows:
-3.3 Except on an emergency basis to serve existing
structures only, e.g. following failure of an
existing private septic system, no Street
Opening/Utility Connection Permit shall be
issued authorising connection to any public or
private sewer line or sewer extension which,
as found by the City Engineer, (a) is
inadequate by reason of its design, condition,
or lack of hydraulic capacity to accommodate
the additional volume of flow or types of
wastes to be discharged from the premises
concerned; or (b) by reason of its design,
condition or hydraulic capacity causes or
materially contributes to upsets, surcharges,
slug loads, or untreated outfalls at any
downstream or other location. x11 permits
issued on an emergency basis under this
subsection shall bear the designation
"Emergency Permit," and shall be subject to
annual review by the Superintendent and/or the
City Engineer. Buy emergency permit shall be
deemed terminated upon correction of the
condition that led t0 its issuance."
"3.4 Except for the purpose of correcting the
violation concerned, no new Street
Opening/utility Connection Permit shall be
issued to any person who has been cited by the
Superintendent for a violation of sections 6,
7, 8 or 9 of this Ordinance, if the violation
remains uncorrected at the time of the
application."
C.O. #95-9 would direct the City Engineer to deny new sewer
connection permits to property owners who are currently in violation
of various
sewer ordinance provisions relating to roof drains,
surchargesetc. An exception is made for certain emergency
situations.
Both of these ordinance amendments are intended to reduce the total
amount of storm water infiltration and other Uncontaminated water
entering the City's saver system. Under our consent decree with the
Environmental Protection Agency and the Maine DEP, the City of Bangor
is required to undertake an annual program of storm water separation
projects. In addition, the consent decree requires the City to adopt
and enforce an ordinance or rules prohibiting the introduction of
uncontaminated water into the sweet system from private sources such
as roof drains, cellar drains, surface drainage and non -contact.

permit additional connections to the sanitary sewer system upon the

system.
Adoption of both the attached ordinance amendments is recommended in
order to comply with specific requirements under the City's EPA/DEP
consent decree, and to generally promote a reduction in uncontaminated
inflows into the City a system, in support of our overall program
of storm water separationand CSO abatement.
