Be it ordained by He City CownEH of He City of Bangor, as foHome: THAT Chapter VII, Article 10 of the Ordinances of the City of Bangor be replaced in its entirety with the following: CHAPTER VII ARTICLE 10 - THE LIFE SAFETY COOK Sec. 1 Adoptipq_Lijfe_eafety Code. In accordance with 30-A M.R.B.A. $.a. 3003 the "Life Safety Code 1994,” 1994 edition, designated at "NFPA $101," and adopted by the National Fire Protection Association, is hereby adopted and incorporated by reference as the Minimum Standards of Construction, Protection and Occupancy of structures and buildings located within the City of Bangor for the purposes of life safety from fire and like emergencies. Sec. 2 Enforcement AµQhority. The Fire Chief, Fire Prevention Bureau Chief, the Code Enforcement Officer or their authorised agent(a), shall have the power and duty to enforce the previsions of this code. Sec. 3 EhfRLAelaapt Procednrea. Whenever the Fire Chief, Fire Prevention Bureau Chief, Code Enforcement Officer o their authorised agent(s), determinate) that there is a violation of any previsions of said code, he/they shall give written notice of such violation to the property r the lessee o cupant, or their agent(s). Suchwritten notice shells (1) Include a description of the real estate in question sufficient for identification; (2) Include a description of the violation(s) found and the criteria to the pertinent provisions of this code; 95-2 (3) Specify the remedial action required for. correction of said violation(s); (4) order that said violation(s) be corrected within a reasonable time, such reasonable time to be determined by the Fire Chief, Fire Prevention Bureau Chief, or Code enforcement Officer and indicated coon such written notice; and (5) State that anappeal from any order, decision, or other action of the Fire Chief, Fire Prevention Bureau Chief, Code Enforcement officer or their authorized aquatic) may be filed with the Building Board of Appeals by completing a written request for a public hearing with the Code Enforcement officer within twenty (20) days after receipt of said written notice. 3.1 Appg$ig. An appeal may be taken from any order, decision, or other action of the Fire Chief, Fire Prevention Bureau Chief. Code Enforcement officer or their agent(s) t0 the Building Board of Appeals (hereinafter referred to as the "Board") established by Chapter IE, Section 121.0, at seg. of the Laws and Ordinances of the City of Bangor. All appeals must be filed in writing on prepared forms with the Code Enforcement Officer, together with an administrative processing fee of thirty five ($35.00) dollars within twenty (20) days from the date of receipt of the order, decision or other action appealed from. The appellant must at the time the appeal is filed also file one extra copy of the appeal which i9 to be provided to the Fire Prevention Bureau Chief by the Code Enforcement Office. The Board may only reverse the order, decision or other action being appealed from if the appellant shows that it can clearly meet the provisions of Sections 1-4 (Application) and 1-5 (Equivalency Concepts) of the Code with regard to any alleged violation. The actions and procedures of the Board, as applicable, shall be governed by the provisions of Chapter IX, Section 121.0, at seg., of the Laws and Ordinances of the City of Bangor. Failure of the Board to issue a written notice of its decision within thirty (30) days of the filing of the appeal, constitutes a denial of said appeal, unless the appellant agrees in writing to an extension of the Board's decision time. 3.2 Apggal_tp�the a egAygLCg}f. Further appeal from the decision of the Board may be made to the Superior Court in accordance with the Maine Rules of Civil Procedure, Rule BOB. 95-0 Sec. 4 yyyal Penalties. The requirements of 30-A M.R.S.A. s.s. 4452 shall apply to the determination of penalties for violations of this Ordinance. The minimum penalty for a specific violation of this Ordinance shall be $100 and the maximum penalty shall be $2,500; provided, however, the maximum penalty may exceed $2,500, but shall not exceed $25,000 when it can be shown that there has been a previous conviction of the same party within the past two (2) years for violation of the same ordinance provision.
