Commentary:
The Planning Board held a public hearing on the above -noted zoning
amendment at its regularly scheduled meeting of November 1, 1994.
No one spoke either in favor of or in opposition to this proposed
"housekeeping' amendment.
The Board voted unanimously in favor of a motion to recommend to
the City Council that the zoning amendment contained in C.O. # 94-
456 (As Amended) be approved.

Item No. 3: Amending the nand Development Code, Chapter VIII,
Article 3, Section 3 - C.O. M 94-456
a. This is an amendment to the definition of Setback. This
would allow handicap access ramps to be placed in the
building setback area
under specified conditions. Under the
existing Ordinance steps are allowed in the setback area,
but there is no similar provision for handicap access ramps.
Under the Americans with Disabilities Act (ADA), buildings.
for public access or public accommodation require handicap
access amps. This amendment allows existing buildings to
more easily conform to the ADA requirements.
b. Staff would recommend that the Planning Board recommend the
proposed land development code amendment (as amended) to the
City Council.
