Amending Chapter 6 of the leve and ordinances of the City of

In response m several Complaints about the eompleity of the slate law regarding mmoist and pedestrian
Wary, and the cat of the associated fines, I prepared the attached odinatme for consideration by the
Council. This ordinance is designed to be w ample as passible and to reduce the associated bass by 50
Percent if the person pays the scatter fee iintend a0ng m man.

(TITLE.) Ordinance, Amending Cbapwrbof thalami and ordinancesof the City oBangor
- Motorist and Pedestrian Safety
Be it ordained by rhe Oty Council of the 01y of Bangor, or follows
THAT Chapter 6 of the laws and Codinances of the City of Bangor be amended by adding a new Article 17,
as follows:
ARTICLE 17 -MOTORIST AND PEDESTRIAN SAFETY

The purpose of this Ordinance is to establish regulations m ensure the safety of pedestrians and motorists
when using the public ways in the City. It is a further purpose of this Ordinance m provide ways for
pedestrians to cross public ways with a reasonable degree of safety without causing unreasonable delay to the
movement of motor vehicle traffic.
2. DEFINITIONS.
Definitions of terms used in this Ordinance shall be as defined in Title 29, M.R.S.A., Section 1, Maine
Motor Vehicle Statures.
3. VIOLATIONS
f No operator of a motor vehicle shall fail to stop for any pedestrian waois in a crosswa&.
3 2 No operator of a motor vehicle may pass or overtake a vehicle which is stopped for a pedestrian in a
crosssodL
3.3 Pedestrians crossing tory, public way must yield to all traffic unless they are within a crosswalk.
3.4 Pedestrians most step off the sidewalk and into the crosswalk to signal to motor vehicle operators that
they intend to use the crosswalk.
3.5 Pedestrians may not enter a crosswalk as that they obstruct a travel lane, if there is not enough time for
oncoming traffic to yield in a safe and reasonable manner.
3.6 Pedestrians at a crosswalk that has working pedestrian traffic control signals may only enter the

crosswalk when the "Walk" word or symbol is displayed. Any pedestrian in a crosswalk when the
pedestrian traffic control signal changes to 'Dong Walk' may continue to the net sidewalk or safety
island.
4. PENALTIES.
4.1 Any motor vehicle operator who operates a motor vehicle in violation of Sections 3.1 through 3.2 of
this Article shall be subject m a fine. Upon a finding by a court that this subsection has been violated,
the operator shall be subject to a civil fine of $100 for such violadon.
4.2 Any pedestrian who violates the provisions of Sections 3.3 through 3.6 of this Article shall be subject
to a fine. Upon a finding by a court that Nu subsection has been violated, the pedestrian shall be
subject to a civil time of $50 for each violation.
5. WAIVING COURT HEARING FOR VIOLATION
5.1 Any person accused of a violation of any portion of this Article will be issued a notice of violation.
Within thirty days of the issuance of the notice of violation Ne person amused may voluntarily waive
his or her right to appear and defend before any Court Ne charge made against him or her for such
violations by paying to the municipality one -ball of the fine indicated in Section 4.1 or Section 4.2 of
this Article.
5.2 If Ne waiver fee has not been paid within thirty days then the police department or legal department
will file the necessary paperwork with the Court to request a hearing.
