Commentary.
The structure, known as 30 Highland Ave and owed by Leon K'ukpatrid, of Brewer was
d«us

deterioration. The building was one of three brought before the Council in 1981 for acquisition and
demolition. The odtertwo buildings were demolished but Mr. Kukpaoid agreed to rehabiliute the
structure. The buildings rebates were required to move in an emergency placarding in late 1983. Mr.
Kirkpatrick has performed a number of projects on the property including boiler replacements (which were
subsequently allowed to freeze resulting in the boilers Ming destroyed), marginal roof and foundation
repairs and ea skier priming burp overall, the buildings state of disrepair has reached the point where staff
concludes it meets statutory requirement for condemnation az a dangerous building by reason of
dilapidation, structural instability, obsolescence and The hazard.

THAT WHEREAS, the Bangor City Council, in its capacity as
the Municipal Officers of the City of Bangor, held a public
hearing pursuant to 17 M.R.S.A. 52851-2859 to determine whether
or not the structure located at 30 Highland Avenue, Bangor,
Maine, on a lot described in a deed recorded in volumes 1609,
Page 107, and volume 1073, Page 114, Penobscot County Registry
of Deeds, owned by Leon E. and Gertrude O. Hirkpat£ick, of
Brewer, Maine, constitutes a dangerous building within the
meaning of said statute; and
WHEREAS, based upon the evidence presented at said
public hearing, the Bangor City Council finds that the building
or structure in question is structurally unsafe; unstable; a
Eire hazard; unsuitable or improper for the use or the
occupancy as a residence; a hazard to health or safety because
of inadequate maintenance, dilapidation, obsolescence or
abandonment, and dangerous to the life and property Of the
inhabitants of the City of Bangor; and
WHEREAS, the Bangor City Council hereby adjudges said
building or structure to be a nuisance and dangerous, as
provided in Title 17 M.R.S.A. 62851-2859,
NOW THEREFORE, by the City Council of the City of
Bangor)
ORDERED, THAT said building or structure shall be
disposed of as follows:
(1) Said building or structure shall be demolished by the
within thirty (30) days of the date of passage
of this Order, said demolition or removal be performed
in onfonnity with the Laws and Ordinances of the City
of Bangor; and
(2) In the event said structure is not demoliehed or
removed within thirty (30) days as provided above, the
City's Code Enforcement Officer may cause said
building or structure to be demolished or removed, all

This letter is to inform you that a public bearing will be convened by the Bangor City Council on
September 25,1996, at 7:30 pm. The hearing will be held in the Council Chambers of
Bangor City Hall, 73 Harlow Street, Bangaq Maine. The purpose of this public hearing is to
take testimony and decide whether to condemn the building or structure located M 30 Highland
Avenue, Bangor, as a dangerous building permanent to Title 17, Sections 2851 through 2859, of
the Maim Revised Severance Annotated.
As owner of this property you are advised to attend this hearing 9 which you will be afforded the
opportunity to present testimony concerning the property. Please feel free to contact me if you

MEMORANDUM

RE: 30 Highland Avewe
As requested on 9/13/961 conduced an exterior inspection of the building located
at 30 Highlaod Avenue. The interior was not accessible. This structure is comprised of
two parts - a two story brick structure with a flat roof and a "daylight" besemmt on the
lower (Charles Street) aide, and a one and one half may wood Gamed addition which
also bas a "daylight' basement facing Charles Street The building appears to be vacant,
has numerous visible structural deficiencies, and is in generally poor condition.
The brick section appears to have a atone rubble foundation and shows numerous
rocks, are which are likely due to settlement and shifting. Although a fatly recent war
of paint covers many of Use cracks, closer inspection reveals that a great many
structural cracks were filled with mortar prior to painting. The exterior wall on the
Highland Avenue side is severely distorted, displaying a bulge which projects about a
foot beyond the normal vertical plane. There is also strong evidence of movement in the
vicinity of the grade level entry at the scrawly comer. A portion of the northwesterly
(back) wall appears an have failed completely, andthere has been some recent repair
activity. There is also a projecting wooden patch on this wall that looks very
goesiormble.
The wend framed section is also in very poor condition. The roof planes have
substantial sags, which suggest failing interior support. The back wall is tipped not
noticeably. Access to the main floor is by a severely rotted set of wooden steps and

This structure is in overall poor condition with evidence of actions structural
problems. I might add that I bad previously inspected this structure for condemnation
considerations well over ten years ago when Sandy Smith was the Code Enfrrcemrnt
Officer. From my recollection, it appear that this building has deteriorated further.
