The Planning Board at its regularly scheduled meeting of August 20,
1996, held a public hearing on the above -noted zone change request.
Dr. Myerewitz, the applicant, spoke in favor of the proposed
change. Are. Leibexnan, anresident, told the Board that
while she was not opposed to the zone change she had concerns about
parking in the area.
No one ape" in opposition.
The Board voted 5 to 0 in favor of a motion to recommend to the
City Council that the zone change request contained in C.O. t 96-
344 be approved.

THAT the zoning boundary linea as established by the Zoning Map of
the City of Bangor dated October 28, 1991, as amended, be hereby
further amended as follows:
By changing a parcel of land located at 50 Broadway (Tax Hap No.
49, Parcel We. 16) from Urban Residence 2 District to Multi Family
and Service District. Said parcel containing approximately 14,400
sq. ft. and being more particularly indicated on the map attached
hereto and made a part hereof.

a. general Description. Applicant requests a zone change for a
Parcel containing approximately 14,400 sq. ft. from IDN -2 to
Multi -Family and Service District at 50 Broadway.
The property is located just two parcels in from State
Street on the west aide of Broadway.
b. Land Use and Zoning Policy. The proposed Multi -Family and
Service District zoning i consistent with the City's Land
Use Polley for this area as well as the proposed Zoning
Policy for this area. -
C. Urban Sery . The site has access to all required urban
services.
d. Existing Conditions. The area in question is somewhat of a
mixture of commercial, residential and mixed office and
residential uses (which is consistent with Multi -Family and
Service Districtzoning). Also, the area is within the
Broadway Historic District. The zoning on the State Street
frontage two lots down from this site is Downtown
Development District, while the property faces an Urban
Service District on the opposite side of Broadway for
approximately half to two-thirds of that block. The
abutting use to the south is an office building and
residential uses north toward the Sohn Bapst High School
site (which takes up most of the Somerset Street and
Penobscot Street block) are generally mixed office and
residential as is the existing use of this property. Zoning
to the rear of the property is UM -2 and zoning between this
property and Sohn Super High School is URD -2, while the high
school itself is Government and institutional Service. The
property beyond the high school on the same side of Broadway
was rezoned to Multi -Family and Service to accommodate the
Seven islands Land Co. office use.
a. Decision Criteria. The basic threshold criteria for any
one change is that it be consistent with the City's
Comprehensive Plan. As noted above, the Comprehensive Plan
calls for Multi -Family and Service use and zoning of this
area. Also, the mix of uses in this area is compatible with
such use. (The present use of the building is nonconforming
in the URD -2 Zone in that it has an office in it.)
E. Recommiendation. The proposed zone change is consistent with
the City's development policies for the area and therefore,
Staff would recommend that the planning Board recommend this
change to the City Council.
