HomeMy WebLinkAbout1996-07-08 96-309 ORDERCOUNCIL ACTION Item No. 96-309 Date duly 8, 1996 Item/Subject: Amending Council Order Authorizing City Manager to Execute Municipal Quitclaim Deed Releasing Title to Property Located at 144-146 Cumberland Street (Tax Map 48, Lot 29) Responsible Department: Legal Commentary On May 13, 1996 the Council approved an order authorizing release of the City's interest in property at 144-146 Cumberland Street. Certain restrictions in the Order have proven to be an impediment to the sale. This amendment removes the reverter provision from the earlier Council Order. The property is currently placarded. It is in the City's interest for the property to be sold, rehabilitated and restored to the tax rolls. The amended Council Order,.like the first, is that the property will be brought in compliance with Code requirements. ORDERED, TMT WHEREAS, by virtue of Council Order 96-212 passed on May 13, 1996, the Bangor City Council authorised the City Manager to execute a municipal quitclaim deed releasing title to property located at 144146 Cumberland Street subject to certain conditions; and WHEREAS, circumstances are now such that certain of those conditions should be deleted, NOW, THEREFORE, By the City Council of the City of Bangor, be it ORDERED THAT paragraph (2) of Council Order 96-212 be amended to read as follows: (2) All current violations of the City of Bangor's building, property maintenance, life safety, fire, plumbing and electrical codes pertaining to 144-146 Cumberland Street shall be corrected to the satisfaction of the `City Code Enforcement Officer. The City Manager is authorized to waive this provision if at the time of delivery of the City's deed the grantee or successor in interest has entered into an agreement for correction of such violations on a schedule agreed to by the City Code Enforcement Officer and performance of such contracts is assured by suitable performance bonds issued by reputable sureties in favor of the City of Bangor, or by other security approved by the City Solicitor. Said deed shall n s grantee the George L. Taoulas Trust or the trust's successor 1 interest. Provided, however, that prior to delivery of the City's deed, the following conditions shall be met by the grantee: (1) All unpaid real estate and personal property tax assessments and sewer r fee bills pertaining to 144-146 Cumberland Street, through and including FY 1996 taxes and FY 1996 sewer bills issued to date, shall be paid in full, including all acrued interest .and lien charges. (2) All current violations of the City of Bangor's building, property maintenance, life safety, fire, plumbing and electrical codes pertaining to 144-146 Cumberland Street shall be Corrected to the satisfaction of the City Code Enforcement Officer. The City Manager is authorized to waive this provision if at the time of delivery of the City's deed the grantee or successor i interst has entered intoallnecessary contracts for correction of such solations on a.schedule agreed to by the City Code Enforcement Officer; performance of each contracts is assured by suitable performance bonds issued by reputable sureties in favor of the City of Bangor, or by other security approved by the City Solicitor; and the City's dead as delivered contains provisions effecting a reverter of title to the City of Bangor in the event grantee fails to correct all such violations within the time agreed.
