Legal The City of Bangor and Bangor. Airport Civic Development Corporation (BaMix) executed a real estate management and development contract on July 29e1991 by which the City engaged BanAir's services for the marketing and leasing of certain properties at the airport.. This contract expires on June 30, 1996, with renewal options for seven 5 -year periods. It is recommended that the contract be extended until August 31, 1996 in order to have ample time to review any other changes deemed necessary to the contract. This review i needed i anticipation of the FAA'a removal of title restrictions on certain non-aeronauticl areas at the airport. THAT WHEREAS, the City is the owner and operator of an airport commonly known as Bangor International Airport, and located in the City of Bangor, County of Penobscot, State of Maine; and wHERHAS, Bangor Airport Civic Development Corporation (Barldr) is engaged in the development and management of real estate in said Bangor; and WHER&]B, the City of Bangor and BanAir executed a Real Estate Management and Development Contract on July 29, 1991 for the marketing and leasing of certain properties at Bangor international Airport; and WHEREAS, said Contract initially was for a 5 -year term with subsequent renewal options, said initial term to expire on June 30, 1996; and WHEREAS, there is a need to extend the June 30th date of the Initial term to allow time in order to review desired changes to the Contract, NOW, THEREFORE, by the City Council of the City of Bangor, be it ORDERED, THAT Edward A. Barrett, City Manager, is hereby authorized to execute on behalf of the City of Bangor a "Amendment to said Real Estate Management and Development Contract and Extension of Contract" by and between the City of Bangor and BanAir by extending the term of the Contract to August 31, 1996. Councilman 96-295 AMENDMENT TO REAL ESTATE MANAGEMENT AND DEVELOPMENT CONTRACT AND EXTENSION OF CONTRACT MIS AMENDMENT AND EXTENSION of the Real Estate Management and Development Contract dated July 29, 1991, executed in duplicate this day of, 1996 by and between the CITY OF BANGOR (hereinafter sometimes referred to as the "City"), auicipal corporation organized and existing under and by virtueof the laws of the State of Maine, and located at Bangor, Penobscot County, Maine and BANGOR AIRPORT CIVIC DEVELOPMENT CORPORATION (herein- after sometimes referred to a "Bennis•),n-profit local development corporation, organized under the laws of the State of Maine and having a principal place of business in Bangor, Penobscot County, Maine. W I T N E S B E T H: WHEREAS, the City and Bannir are parties to a certain 'Real Estate Management and Development Contract" (hereinafter sometimes referred to as "Contract") dated July 29, 1991 regarding the marketing and leasing of certain properties at Bangor International Airport; and WHEREAS, said Contract expires June 30, 1996; and WHEREAS, the parties wish to extend said Contract but not for the terms of extension provided for in said Contract, NOW, THEREFORE, the parties do mutually agree as follows; 1) THAT ARTICLE II, OPTIONS TO EXTEND, be deleted. FORMER, the parties do mutually agree that the Contract shall, in all other respects, be extended to August 31, 1996.
