The State of Maine, through the Department of Transportation,
recently condemned and acquired various parcels of land for the
purpose of upgrading the I-95/Union Street Interchange. A 10' x
60' remnant lot formerly owned by Bertha B. McElwee of Bangor was
among the parcels acquired. Title to the lot concerned is in the
City of Bangor, by virtue of axundischarged tax liens for FY 1968
(2 liens), 1969, 1970, 1971 and 1972 recorded at the Penobscot
Registry of Deeds.

ORDERED,
THAT the City Finance Director is hereby directed to
execute and deliver to the Maine Department of Transportation,
a municipal quitclaim deed, in the form attached, releasing all
right, title and interest in and to land formerly owned by
Bertha B. McElwee, located adjacent to Interstate Highway 95,
to the rear of Tax Map 11, Lot No. 4B.

MUNICIPAL QUITCLAIM DEED
The CITY OF BANGOR, aicipal corporation located in
Bangor, Penobscot County, Maine, as Grantor, for consideration
paid, releases to STATE OF MAINE DEPARTMENT OF TRANSPORTATION, a
successor in interest to Bertha B. McElwee, as Grantee, of Bangor,
Penobscot County, Maine, land in Bangor, Penobscot County, State of
Maine more particularly described as follows:
A portion of the land formerly of Edward H.
Baker as described in Book 1080, page 330,
Penobscot County Registry of Deeds, being a 10' '
by 60' remnant lot adjacent to the Interstate
Highway 95 right-of-way, and lying to the rear
of lot 4B as depicted in Map 11 of the Bangor
City Ass8580r'6 tax maps.
Being the same land acquired by John G. Field,
City of Bangor Collector of Taxes, by virtue of
undischarged tax liens for tax years 1967 (2
liens), 1968, 1969, 1970, and 1971 recorded in
the Penobscot County Registry of Deeds in Book
2100, Page 479; Book 2100, Page 480; Book 2129,
Page 737;Book 2158, Page 316; Book 2184, Page
699 and Book 2213, Page 654 respectively.
This deed is given in confirmation of a recent eminent
domain acquisition of the above described premises by the State of
Maine Department of Transportation.
The said CITY OF BANGOR has caused this instrument to be
Baled with its corporate seal, and signed in its corporate name by
RONALD I. HELLER, Finance Director, thereunto duly authorized, this
day of , 1996.

COMMENTARY continued:
The attached Order, will ratify action by the City Council's
Finance Committee on June 17, 1996, authorizing a release of the
City's titleupon payment of the six tax liens in their original
amounts without interest. Bertha B. McElwee paid the lien amounts,
concerned ($205.97) plus the City's $70.00 quitclaim deed fee, on
June 18, 1996. In return, the Finance Director has endorsed to
Mrs. McElwee a $750.00 check from MOT to Mrs. McElwee and the City
of Bangor, constituting the amount awarded as damages for MOT's
taking.
