Commentary
For the past several years, the City has been discussing
acquisition of a 30+ acre parcel of land owned by Maine Central
Railroad Company (Tax Map 43, Lot 40), located on the Bangor
Waterfront, with the railroad. Those discussions have been
complicated by the need to address environmental liability issues
potentially arising out of use of the parcel by Maine Central
Railroad as a railroad switching yard and maintenance facility for
more than 100 years. An acceptable agreement has been negotiated
with the railroad, which contains provisions addressing
environmental liability issues.

The attached Council Resolve would authorize the City Manager to
execute a purchase and sale agreement for the acquisition of this
property, in a form approved by the City Solicitor. The agreement
contemplated by this Resolve will be substantially the same
document rewed recently by the City Council in several executive
sessions. Arfinal version of the purchase and sale agreement will
be available at Monday night's Council meeting. If the agreement
has not been finalized by Monday, this Resolve should be postponed
to the Council's next regular meeting (May 29, 1996).

the City Manager is hereby authorized, on behalf
of the City of Bangor, to execute a purchase and sale agreement
with Maine Central Railroad Company for acquisition of property
owned by. the Railroad bounded generally by Main Street, Railroad
Street, the Penobscot River, and the Veterans' Remembrance Bridge,
and depicted in the City's tax maps as Nap 43, Lot 40. The
purchase and sale agreement shall be in a form approved by the City
Solicitor.
