MDOT's Baogm Brewer Bridge Replacernem project is cummNy under conatruction. This project ala,
includes installation of rrew traffic signals at the intersections of Oak St. and Weshistgton St. and at
Hancock St. and Newbury St.
The attached Order would authorize the City Manager to execute a routine hduniclpaFStme Agreeamnt
for the City to opetme and maintain the new signals after the project is completed. There is no IoW cost
for construcfion.

MUNICIPAL/STATE AGREEMENT
BETWEEN THE STATE OF MAINE
DEPARTMENT OF TRANSPORTATION
AND THE
CITY OF BANGOR
REGARDING
PROPOSED TRAFFIC SIGNAL INSTALLATIONS
INTERSECTION OF WASHINGTON & OAK STREETS
AND
NTERSECTION OF HANCOCK & NEWBURY STREETS
PROJECT IDENTIFICATION NUMBER 26M.00
FEDERAL AID PROJECT NO. BR -BREWS -1(35)
This AGREEMENT is entered iNa on this day of , 1996 by
and between the STATE OF MAINE DEPARTMENT OF TRANSPORTATION (hereafter
DEPARTMENT) and the CITY OF BANGOR, a body corporate and politic located in the
County of Penobscot (hereafter MUNICIPALITY) regarding the installation, operation and
�• of new traffic signals 9 the vnereeetion of Waimington and Oak Streets and at the
intersection of Hancock and Newbury Streets in Bangor, proposed as a pan of the project to
construct the new Bangor -Brewer Bridge over Ne Penobscot River between Bangor and
Brewer (hereafter project) as follows:
1. The DEPARTMENT shell install new Polly -w tuned traffic signals at the intersection of
Washington and Oak Staffers and at the intersection of Hancock and Newbury Streets in
Bangor in accordance with the plans and specification; developed for the project, to which
reference is hereby made.
2. The MUNICIPALITY shall be responsible for all operational sed mormenance costs for
the two mcffnc sigrals hereinbefore descried and shall operate and mention both of the
traffic signals and all controlling devices and fixNres aplmrteriam thereto in function as
designed and installed by the DEPARTMENT, unless approved otherwise as hereinafter
provided, or as necessary as follows:
a. Ali malfunctions and deficiencies in Ne traffic signals or any controlling devices shall
be repaired or corrected expeditiously.
b. The visibility of the traffic signals shall be preserved sued maintained at all times by
removing any visual impamannis s tbereto.
c. No change in operation or modification shall be made in the traffic signals or any of
the controlling devices wiabout the express written approval of the DEPARTMENT.
d. The DEPARTMENT shall be notified in writing prior in any removal or replacement
of either of the two traffic signals or any of the controlling devices. Upon removal,
any such traffic signal or controlling device so removed shall be returned to the
DEPARTMENT, without any cast to me DEPARTMENT, un ess otherwise agreed to
in writing.
