STP-95d6W(aq Responsible Department: Engineering Commentary: MDOT will be undertaking a project to construct a new I-95 northbound off ramp which will eliminate the dangerous "scissors° ramps between Union Seat and Ohio Street, Inducted with this project is installation of new track signals on Union Shat at the ramp intersections. The attached Order would authorize the City Manager to execute a routine Manicipal/State Agreement for the City to operate and maintain the new signals after the installation is completed. Councilman MUNICIPAL/STATE AGREEMENT BETWEEN THE STATE OF MAINE DEPARTMENT OF TRANSPORTATION AND THE CITY OF BANGOR REGARDING PROPOSED TRAFFIC SIGNAL INSTALLATIONS UNION STREET AT INTERSTATE 95 OFFRAMPS PROJECT IDENTIFICATION NUMBER 5663.00 FEDERAL AID PROJECT NO. STP -95-5663(0(3) This AGREEMENT is entered into on this day of , 1996 by and behvcen the STATE OF MAINE DEPAR11E3NT OF TRANSPORTATION (hereafter DEPARTMENT) and tie CITY OF BANGOR, a body corporate and politic located in the l County of Penobscot (hereafter MUNICIPALITY) regarding the installation, operation and maWeoavce of new traffic signals on Union Street m Bangor proposed as a part of a project to construct a new northbound off -ramp from Brerstate 95 to said Union Street (hereafter project) as follows: 1. The DEPARTMENT shall install new fully-acmared traffic signals on Union Street in Bangor at its intersection with the new Interstate 95 mrthbourd off -ramp ant at its intersection with the present Interstate 95 southbowd off -ramp in accordance with the plans ant specifications developed for the project, to which reference is hereby made. 2. The DEPARTMENT shall also install all pavement mailings and traffe control signs as necessary sal incidental to the project on a onetime basis on the new ramp ant at the two traffic signal locations on Union Street. 3. The MUNICIPALITY shall be responsible for all operational arta maintenance costs for Me traffic signals to be installed at the two locations hereinbefore described and sball operate ant maintain both of the traffic signals and all controlling devices and fixtures appurtenant Moreno to Ruction as desigrwd oral irotdlM by the DEPARTMENT, unless approved otherwise as hereinafter provided, or as necessary, as follows: a. All malfunctions and deficiencies in the traffic signals or any controlling devices shall be repaired or corrected expeditiously. b. The visibility of the traffic signals shalt be preserved and maintained at all times by removing any visual impairmvns Menem. c. The DEPARTMENT shall be notified in writing prior to any removal or replacement of either of the two traffic signals or tory of tle controlling devices. Upon removal, any such traffic signal or controlling device so removed shall be returned to the DEPARTMENT, without any cost to eM DEPARTMENT, unless otherwise agreed to in writing. 4. The MUNICIPALITY shall be responsible for the maintevavice of all pavement markings and traffic creatural signs installed on Union Street that are necessary and incidental to the proper operation of the two traffic signals as intended by the project, and the DEPARTMENT shall be responsible for all such maintenance on the Interstate 95 off - ramps.
