HomeMy WebLinkAbout2017-11-27 18-032 ORDINANCETitle, Ordinance 18-032 11/27/2017 Repealing Council Ordinance 17-338 Enacting Moratorium on Secure Psychiatric Facilities Summary This ordinance would repeal Council Ordinance 17-338 which had placed in effect a moratorium on secure psychiatric facilities. On September 25, 2017, by Council Ordinance 17-338 the City Council imposed a moratorium on the permitting of secure psychiatric facilities in Bangor. The State of Maine had expressed interest in placing a secure forensic facility in Bangor. The City had concerns about State's proposal, including the appropriateness of its chosen location and security and the concerns had not been addressed thereby raising questions about the function of the facility, any effect on the City, and whether the City's Land Development Code needed to be amended to address any issues. The lack of information contributed to the need for a moratorium. Since enactment of the moratorium staff has reviewed the documents of the State's application for a secure psychiatric facility with the City of Augusta Planning Board and the Planning Board's records and met with State officials, including the Commissioner of the Department of Health and Human Services. Based upon the information received by the City since enactment of the moratorium, the City's Land Development Code is sufficient to address the City's concerns if the secure psychiatric facility is located on the campus of Dorothea Dix Psychiatric Center facility in Bangor.
