HomeMy WebLinkAbout1996-03-25 96-165 ORDERCOUNCIL ACTION item No. 96-165 Date March 25, 1996 Item/Subject: Amending Council Order 96-22 (Discontinuance of Patten Street as a Public Way Between Main Street and Hellier Street) Responsible Department: Legal Commentary: The attached Council Order will amend Council Order 96-22 (discontinuing a portion of Patten Street) to extinguish public easements. In substitution for the existing public easements, the City and the Bangor Water District will receive deeded easements for public water and sewer at the time this property is formally conveyed to the Shaw's project developer. This action is necessary due to a contemplated relocation of the existing sewer and water lines, and for the developer's title insurance purposes. New City NBesynr OB zmt TWT WHEREAS, a major redevelopment project is in progress for the former Gas Works site and all other properties abutting the lower portion of Patten Street between Main Street and Dallier Street; and WHEREAS, said .abutting properties on. lower Patten Street have been acquired for the redevelopment project; and WHEREAS, said portion of Patten Street right -o£ -way between Main Street and Collier Street was discontinued as a Public Street by Council Order. 96-22, passed November. 13, 1995, with an effective date of April 1, 1996; and WHEREAS, Council Order 96-22 provides that "2) An easement shall be reserved within thediscontinuedsight-of- way for. purposes of maintaining public a drainage, and water facilities by the City of Bangor and the Bangor Water District"; and WHEREAS, the project developer proposed that the public easement in Patten Street be extinguished and that deeded easementsin favor of the City of Bangor and the Bangor Water District be substituted for the existing public easement, at locations to be ,designated in the deeded easements; NOW, THEREFORE, BE IT ORDERED THAT, Council Order 96-22 as adopted on November 13, 1995 be amended by deleting numbered paragraph 2 and substituting the following: 112) No public easement shall be retained in the discontinued portion of Patten Street." And that Council Order 96-22 as adopted November 1, 1995 shall otherwise remain in full force and affect.
