The City enacted a moratorium on retail marijuana establishments and retail marijuana social clubs on November 1, 2016 by Council Ordinance 16-387. The moratorium was originally set to expire on April 30, 2017. The Council then extended the moratorium until October 27, 2017 by Council Ordinance 17-121. The City Council and City staff have made reasonable progress to alleviate the reasons that gave rise to the need for a moratorium, through research, testimony in front of the Maine Legislature, and consideration of different approaches. However, the problems that gave rise to the moratorium, as indicated in the Ordinance in which the moratorium was passed, still exist. Furthermore, there are currently pending before the State of Maine Legislature certain proposed changes to the Marijuana Legalization Act. It is unlikely that the proposed changes will become law before the expiration of the moratorium. This will require a two-thirds vote of the Council. The ordinance would therefore take effect on October 21, 10 days after being passed.
