Commentary:
This Order would authorize acceptance of $3,300.00 awarded by the
Maine Dept. Of Transportation and tendered as damages for the
State's acquisition of a strip of land in front of Mary Snow
School, and a smaller piece Of land adjacent to the Interstate 95
southbound entrance ramp off of Broadway. Both parcels have been
acquired by the Maine DOT in connection with a planned Broadway
widening project.

ORDERED,
THAT the City Solicitor, on behalf of the City of
Bangor, is hereby authorized to accept an award in the amount of
$3,300.00 from the Maine Department of Transportation, as damages
for the State of Maine's acquisition of two parcels of City -owned
land in connection with the Maine Department of Transportation's
Broadway widening project. Damages awarded and the land acquired
are further described in a letter from the Maine Department of
Transportation dated August 18, 1999, on file in the City
Solicitor's office.

WHEREAS, It has been determined that the public exigency requires the construction or
reconstmction by altering, widening, changing the grade and changing the drainage or a portion of
State Highway "38” in the City of Bangor, County of Penobscot; and State of Maine.
WHEREAS, the necessary property has been surveyed, appraised and a plan drawn known as
Right of Way Map, State Highway No. '38", Project No. NHSTP-030P(41)X, dated October, 1996 on
file in the office of the Department of Transportation, Right of Way Division, File No. 10-370.
WHEREAS, a certain parcel of land in said Bangor, located on the right side of said highway
between
Station 10+030± and Station 10+149.4± Grading
Station 10+0753 and Station 10+149.4± Land
Station I-95 and Station 10+128,0± C.O.A.
Station and Station
is required for construction of above designated project, and
WHEREAS, the undersigned do hereby acknowledge that Spence Stewart, RNV Agent of the
Maine Department of Transportation, mel withfwrote to me/us and explained rights required, damages
and all construction changes of location, grade drainage and slopes.
NOW THEREFORE, the undersigned do hereby propose to the State of Maine:
1. That it acquire the necessary land and rights in icted on the before mentioned Right
of Way Map, by Eminent Domain on or before ust t9, 1997
2. That it pay the undersigned the sum f$3,200.00 at the time of acquisition.
