We delayed updating this code in anticipation of the three major code authorities, in the US., BOCA, SCR and UBC joining together to produce a single mechanical code which would be recognized internationally. These three entities are now working towards a uniform building code which is expected to be published In 20W. The format chosen, by the International Code Committee, was the format historically used in the BOCA Mechanical Code. In accordance with 30-A M.R.S.A.§ 3003, the lntematiormi Building Code/1996, published by the International Cade Council, Inc. is hereby adapted and ncorpomted by reference, as Ne minimum standard for Ne design, installation and maintenance of all mechanical systems in the City of Bangor, including heating systems, ventilating systems, cooling systems, stwm and hot water heating systems, process piping, boilers and pressure vessels, appliances utilizing gas liquid or solid fuel, chimneys and vers, mechanical refiigemtion systems, fireplaces, barbecues, crematories, Bre protection systems and air pollution control systems. Said Mechanical Code is adopted in its published form as if fully set forth herein, except as follows: (1) Section M-100.1 is amended to read as follows M-100.1 Title: This Cade shall be known as the Mechanical Code of the City of Bangor hereiamer referred to as the Mechanical Code or'this Code." (2) Section 103.1 is deleted in its entirety and replaced with the following: MA 03.1 Branch The Code Enforcement Officer shall be designated the Code Official for the purposes of this Code. . (3) Section 103.2 is deleted m its entirety. (4) Section 106.5.2 is amended N read as follows: 97-96 106.5.2 P o o -ti d d :The fees for all mechanical work shall be as indicated in Chapter 11, Article 37 of Me Laws and Ordinances of the City of Bangor. (5) Section 108A is deleted in its entirety and replaced with the following: 108.4 Civil Penn lit : The requirements of 30-A M.R.S.A. § 4452 shall apply to the determination ofpenalties for violations ofthis Ordinance. The minimum penalty fora specific violation ofthis Ordinance shall be $100 and Ne maximum penalty shall be $2,500; provided, however, the maximum penalty may exceed $2,500, but shall not exceed $25,000 when it can he shown that there has been a previous conviction of the same perry within the post years for violation of the same Ordinance provision. (6) Section 109.0 is deleted in its entirety and replaced with the following: 109.0 Appals: An appeal may be taken from any order, decision or other actino of Me Code Official to the Board of Appeals (hereinafter celled Ne "Boon' established by Chapter II Article 38 ofthe Laws and Oninances of the City ofBangm. The matter Mail be heard by the Board in accordance with the procedures set out in Chapter a Section 121.0 of the Ordinances of the City of Bangor.
