Responsible Department: Planning Division The Planning Board held a public hearing on the above -noted zone change request at its regularly scheduled meeting of January ], 1997. Tim Brochu, of C.E.S. Inc., represented the applicants and spoke in favor of the proposed zone change. No one spoke in opposition to the request. The Board voted 5 to 0 in favor of a motion to recommend to the City Council that the zone change request contained in C.O. R 97- 55 be approved. General Description. Applicants request a zone change from Rural Residence and Agricultural District to Shopping and Personal Service District for a parcel of land containing approximately 1 88 acres located on north side of the intersection of Stillwater Avenue and Kittredge Road. (This parcel is composed of two existing lots and part of a third lot and applicants are contract holders with three property owners to make up the parcel.) b. Land use and Zoning Policv. The proposed use of the area within which the parcel lies is for commercial in the City's Comprehensive Plan. Furthermore, the existing commercial zoning on the other three corners of the Kittredge Road/Hogan Road/Stillwater Avenue intersection is Shopping and Personal ServiceDistrict. Staff feels that the lot is clearly consistent with the City's development policy as expressed in the Comprehensive Plan for this area. Also, the zone change is consistent with existing zoning and existing uses in this area as all of the other comers of the intersection are either vacant or developed with commercial uses. C. Urban Services. The proposed parcel has a full range of urban services available and lies within the Primary Service Area boundary as delineated in the City's Comprehensive Plan. d. Existing Condit ons. The subject parcel is comprised of several existing lots which were previously used for residential purposes. Because of the vee -shape of the parcel formed by Kittredge Road and Stillwater Avenue there was very little area on the lot at the intersection itself for commercial development and applicants have assembled three parcels to make an adequate size parcel for commercial reuse. Directly across Stillwater Avenue from this lot is a small (narrow) lot owned by the City of Bangor which has a drainage ditch running through it and the McOuik's site. There is a gasoline service station and car wash directly south of the property on the southerly corner of the intersection and the Country Hospitality Inn molal is across Kittredge Road to the west of the property. (Future plans call for discontinuance of Kittredge Road in this intersection at such time as Hogan Road is extended in a northwesterly direction so that there will be proper alignment of the four legs of the intersection.) e. Decision Criteria. The propomd zone change appears to be wnaiatent with both the City's Comprehensive Plan and the zoning in the immediate area. Staff would therefore, recommend that the Planning Board recommend the proposed zone change to the City Council.
