Since then, staff has developed a draft Council Order establishing the policies and procedures to be followed in setting up and administering this new program. A draft Council Order is attached. This Order will be reviewed and discussed at the Community and Economic Development meeting of Wednesday, November 20, 1996. We anticipate that residents of Montgomery and Grant Street will have comments and suggestions and that the Committee may recommend changes. Definitions. Posting of Rmidential Parking Permit Area. (a) Following the City Council's affirmative vote to designate a residential puking permit area, puking signs shall be erected in the designated area. (b) The signs shall indicate prominently that curbside puking on public streets and highways in the designated area is not permitted between the hours of 6:00 a.m. and 5:00 p.m. on weekdays, excepting holidays, unfess the vehicle properly displays a parking permit authorized by Chapter Dl, Article 6, Section 4.7 of the laws and Ordinances of the City of Bangor III. Notice to Residents of Designation of Residential Parking Permit Area. Following the City Council's affirmmive vote to designate a residential puking permit area, the Police Chief or his designee shall mail to every residence within the designated residential parking permit area the following documents: (a) A Notice of Designation that shall inform the residents in the designated area of: (I) The existence, exact location, and munairal desigwtion of the residential Parking permit area; (2) The Parking restrictions applicable to all vehicles in curbside parking spaces along public streets and highways is the designated area that do not display a parking permit authorized by Chapter III, Article 6, Section 4.7 of the Laws and Ordinences of the City of Bangor; and (3) The procedures to obtain a residential, visitor, or business parking permit. (b) An Application for Residential Parking Permit on which the applicant is to Provide the following information for ezcb vehicle to receive aresidential puking pamiL (I) The rune and residential address of the owner of the vehicle; (2) The mane, residential address, and driver's license number of the principal operator of the vehicle; (3) The make, model, anal license plate/registration number of the vehicle; and (4) The signorine of the applicant for the residentiatparking permit. 2 9)-36 (c) The applicant And demonstrate proof of residency and motor vehicle ownership in a manner determined by the Police Chief or his designce. (d) The City Council may, by resolution, limit the number of permits issued to my residence if such limitation would further the goals of the residential parking. permit process. N. Issuaoee of Residential Parking Permits. (a) Upon theapplicamPs payment of a ten dollar ($ 10.00) residential parking permit nee, submission of a completed and validated residential parking permit application, and fulfillment of all applicable provisions of this Order controlling issuance or transfer of residential parking permits, the applicant shall receive one (I) residential parking permit for the vehicle described in the application. The residential parking Permit shall be securely affixed to the inside bottom left corner of fine Gout windshield of the vehicle and shall display the following iNbrmation: (1) The license plate/registration number of the vehicle; (2) The numerical designation of the residential parking permit area; and (3) The expiration date of the residential parking permn which shall be one (1) year from the date of issuance. (b) No residential parking permit shall be issued to a vehicle whose owner and Principal operator do not reside origin the designated residential puking permit offen- (c) The applicant for, and holder of, the residential parking permit shall be the owner or principal operator of the vehicle receiving the parking permit. (d) Avehicle shall be issued a residential parking permit only if it displays valid State of Maine license plates. V. Transfer or Replacement of Residential Parking Permits. (a) Upon the holders payment of a five dollar ($5.00) residential parkiog permit transfer fee, submission of completed and validated residential parking permit application, fulfillment of all applicable provisions of this Order controlling issuance or transfer of residential parking permits, and surrender of the existing residential parking permit, the holder shall receive a new residential parking permit to be trainfiersed to another qualifying vehicle. F 9]-36 (b) Upon the holder's payment of a five dollar($5.00) residential puking permit replacement fee, verification of the holders prior submission of a completed and validated residential parking permit application, fulfillment of all applicable provisions of this Order contracting issuance or transfer of residential parking pemdts, and affirmation that the holder's permit was lost, smles, or destroyed, the holder shell receive a new residential parking permit. The loss stolen or destroyed permit shall be considered void, and any use of voided permit is Prohibited, (c) The transfer in replacement of fire residential puking permit shall not affim the permit's original expiration date. VI. Issuance of Permits for Visitors. Upon application of my resident of a residential puking permit amn, the Police Chief or his designee shall issue no more then two visitor parking permits ro the resident for visitor vehicles. For the purposes ofthis Order, the resident shall be the holder ofand responsible for the use and misuse of the visitor parking pemrits issued to the resident. VII. Issuance of Permits for Persons Doing Business with a Resident. Upon application of my resident of residential parking permit area and any person doing business with this residers, the Police Chief or the Police Chi of designee may issue a business puking permit to the resident for flue vehicle of the person doing business with the resident on be limited an that particular parking permit area for a period not exceeding the estimated time as shown on the application, required to complete the business transaction. No business parking permit shall be valid for more than thirty(30) days. For rhe purposes of this Order, the resident shall be the holder of and responsible for the use and misuse of the business parking permits issued to the resident VIII. Display of Visitor and Business Parking Permits. All visitor and business parking permits shall be displayed on or about the Front windsbieldofthevehicle soasto beeasily visible fmmoutside thevehicle. Suchparking permits shall contain the following information: (a) The numerical designation of the residential parking permit area; (b) The name and address of the resident to whom the puking permit was issued on behalf of the visitor or person doing business with the resident, and (c) The expiration date of the parking permit 97-36 EL Use of Parking Permits. (a) A parking permit shall not guaootee or reserve a puking space witbina designated residential parking permit area. A parking permit shall not authorize the standing or parking of my vehicle in such places and during such times when the stopping, standing or parking of vehicles is prohibited or set aside for specified types of vehicles, and shall not excuse the observance of any trati c regulation. (b) Whenever the holder of a residential, winner, or business puking permit, or the vehicle for which the parking permit was issued, no longer fulfills one or more of the applicable provisions of this Order controlling issuance or transfer of puking pe,nmits, the holder shall artily the Police Chief or the Police Chiefs designee, who may then direct the holder to surrender the parking permit. (c) Until its explosion, surrender or revocation, a parking permit shall remain valid for such time as the holder continues to reside within the designated residential Parking permit area. (d) Apukmg permit shall be valid only in the residential parking permit area for inch it is issued. (e) No holder of a puking permit shall fail on amender the permit when directed to do so. (t) No person shall represent in any fashion that a vehicle is entitled to a packing permit authorized by this Ordinance when it is not so entitled. The display of puking permit on a vehicle not entided to such a parking permit shall constitute such a representation. (g) No person shall duplicate, or attempt to duplicate, by ally means, a parking permit aoNorized by Chapter III, Article 6, Section 4.7 of the Laws and Ordinances of the City of Bangor. No person shall display on any vehicle such a duplicate parking pmnit. K Exemptions. (a) Whenever metered parking is in effect in any portion of a residential parking Permit area, the parking spaces combatted by meters shall be excepted from the - provisions of this Order so long as the control by meters continues. 9]-36 (b) The following vehicles are specifically exempted from the paling restrictions imposed by Chapter III, Article 6, Section 4.7 of the Laws and Ordinances of the City of Bought: (I) Amotar vehicle owned by or operated under contract to a utility when used in the construction, operation, removal or repair of utility property, or facilities or engaged in authorized work in the designated residential parking permit area. (2) A motor vehicle identified as owned by or operated under contract ma federal, state, or local govemmevtnl agency and being used in the course of official government business. (3) An authorized emergency vehicle as defined by state law.
