Authorizing Execution of Contract with Burns and McDonnell for Remediation of the Secondary Active Zone
within the Penobscot River in the Estimated Amount of $500,000
The City has been working with representatives of Burns & McDonnell for approximately 18 years to develop
methods to mitigate the coal tar contamination within the Penobscot River. This work is required as part of
the City's Consent Decree with the State of Maine Department of Environmental Protection.
The City constructed a cap to the primary active zone, which isolated and encapsulated a significant portion of
the coal tar contamination which has eliminated the vast majority of the coal tar that was migrating to the
water's surface as well as functioned as intended.
For the past two years, the City and Burns & McDonnell have been in the design/permitting phases for a
similar cap for the secondary active zone. Due to the nature of the work there is a small window available to
complete the work this fall.
The attached order would authorize the execution of a contract with Burns & McDonnell to complete this work
this fall in the estimated amount of $500,000. Burns & McDonnell will provide construction management and
inspection services for this project as well as contract with the competitive contractor, Sargent Corporation.

The Finance Director is hereby authorized to execute a contract with Burns and McDonnell for
remediation of the secondary active zone within the Penobscot River in the estimated amount of
$500,000.
