The meeting was called to order at 1:00 p.m. It was noted that no minutes from our last meeting September 16, 2011 were distributed. Minute are to be distributed electronically and reviewed at our next meeting. Item #2 was the review of 1321 Essex Street. Bill Phillips noted that he was on the Board of Directors of Bangor Land Trust (BLT) and a concern was raised that making decision on this project might be a conflict of interest due to the fact that it abuts the BLT land. It was determined that since the Land Trust had no financial interest in the project no conflict existed. The question was raised regarding the sight distance for each proposed lot. The Bangor Planning Board will review sight distance at their meeting. The question was raised regarding the required frontage of these lots. David Gould informed the commission that all lots have the required 150 foot frontage. It was noted that this land had been separated into 3 lots. Six new lots are being created. One of the original 3 lots was purchased by BLT, which is lot 2A along the rear of the property. This lot was purchased with Land for Maine’s Future funds so it cannot be developed in the future. The proposed new subdivision dedicates Approximately 20 Acres as open space. Jim Hinds would like to see a copy of the conservation easement. All of these new lots have a 20 foot set back from the rear property line. The commission Recommended the plan proceed to the Planning Board. 3. Other Business: Concerns were raised the Marsh Mall TIF funds were being reallocated for uses other than those specified in the original TIF agreement. 1 All TIF funds remain in a separate account, except approximately $13,000.00 which was utilized to continue water quality monitoring of the Penjajawoc Stream. This is an approved use of these funds. December 27, 2010 by Council Order 11-046. the original Penjajawoc Marsh/Bangor Mall Area Management Fund Development and Tax Increment Financing District #1 Development Program was amended by Bangor City Council. This Amendment extended the term that the City had to complete the project Identified in the original TIF, February 11, 2008 by Council Order 08-092 form 10 to 30 years. Also as part of that amendment design, construction, grooming or improvement new or existing recreational trails were added to the list of projects. Any funds not utilized to complete the projects identified originally or as amended within the Marsh /Mall Area TIF within the specified term, but not before it expires, will be reassigned to the City of Bangor’s Downtown TIF. 2
