The Penjajawoc Marsh/Mall Commission met Friday, March 7, 2008 in the City Council Chambers.
Shep Harris, Chair called the meeting to order at 1:00 p.m. The February 1, 2008 meeting summary
was approved with the changes south Penjajawoc and George questioned a site visit for the Molly
Lane South Subdivision.
Don Becker presented revised plans for Molly Lane South with five lots. He spoke to the Commission
about wetland species and outlined wetland delineation previously done at this site. Prior subdivision
approval showed wetlands (1990). Five years ago the original Molly Lane was approved (no new
wetland mapping). Last summer Roger St. Aman/Tim Brochu delineated the resource protection
boundary but did not do wetland identification on the internal part of the parcel. Don noted that
apparently all work he thought had been done was not. Jim Ring provided an overview of how
Department of Environmental Protection reviews and determination of wetlands. Jackie Hewett
requested that an independent person do internal delineation with DEP review. Don thought this
seemed possible and appropriate. George asked about filling of wetlands which can occur with
permit. There was discussion about applicable zones and setbacks, in particular shoreland overlay/RP
75’ setback and separate DEP regulation if delineated “significant”. Shep stated concern about
fertilizer use going into wetlands via proposed drainage easement. Jackie raised questions which
prompted subsequent discussion of stormwater treatment. Don suggested the Commission could
recommend specifics to the Planning Board. There was much interest in effectiveness and application
of different treatment approaches. Don Becker mentioned that all five lots could have gravity
foundation drains. Lucy talked about USACE’s approach to “avoid/minimize/mitigate” wetland
impacts. USACE has authority on small areas but delegates permits for over 0.10 acres disturbance
to DEP. Don would keep Jim Ring apprised and report to the Commission.

Andy Hamilton proved an overview and description of the site and project located at 444 Stillwater.
There was some discussion and explanation of traffic movement, a review of the checklist. Jim Hinds
moved and Marion Rudnicki seconded, all in favor to recommend. Lucy suggested it would be good
to develop a preferred list of native planting species for use in this area.
There was a discussion on future steps regarding Land and Open Space. Jackie Hewett thought
current outlining and prioritization is a good start and maybe should pursue grants, etc. Lucy
questioned the issue of land banking and possible changes to allow flexibility. George Elliott agreed
and made reference to Bangor Trails, Bangor Land Trust activity, and a discussion of Bangor Trails.
There was concern about the need to revisit prior planning draft policy regarding set asides and
eligibility toward open space requirements for future development. The Commission requested copies
of draft language in advance of the next meeting.
There was no Bangor Land Trust news to report. Judy talked about 2006 Least Bittern survey in the
Marsh.
Ed to provide an open space map for the next meeting. Shep indicated he would be away for the
next two meetings and Jackie said she would miss the April meeting.
The meeting was adjourned at approximately 2:40 p.m.
