Committee convened at 5:00 p.m.
Consent Agenda
1. Sewer Abatement Request: 170-176 Bolling Drive – Account # 083093

Councilor Palmer moved to pass items 1, 2, 3 with no discussion, Councilor
Blanchette seconded.
Regular Agenda
4. Referral: Order 08-126 to Establish On-Going Special Committee-Downtown
Parking Advisory Committee
Ed stated the Committee suggested the Downtown Parking Advisory Committee
be “in office” year round. Councilor Palmer suggested there be a disabled
member as part of the Committee. Motion to amend was made by Councilor
Palmer and seconded by Councilor Stone. Motion made to pass with amendment
there be an additional position was made by Councilor Blanchette and seconded
by Councilor Palmer to move. Passed with a unanimous vote.
5. Easement for Bangor Opera House Marquee Columns
Paul gave an overview of the addition of the columns. Originally there were
columns, but in the past few decades the marquee supports were attached to

the building. The request is to acquire an easement to restore columns in
conjunction with the restoration to restore the Bangor Opera House to its original
state. Nathaniel Rosenblatt and Bob Kelly were present. Bob Kelly explained to
the Committee the stress it has placed on the building to have the marquee
supported by the building. The columns would be made from steel both the
base and the columns and anticipated they would be hollow, not cement filled.
Councilor Palmer was concerned for the damage that may be done due to
plowing and other potential damaging factors. Paul Nicklas stated there were no
issues. Jim Ring referenced page 67 of the packet stating there was more
space than what was required. Jim suggested a provision be placed in the
easement that the City of Bangor be exempt from damages due to plowing and
other potential damages. Motion made and seconded.
6. Discussion of Possible Amendment to Land Development Code to Ensure
Compliance with Development Conditions – Request by Councilor Stone
Paul provided a handout of the proposed Ordinance amendment. Ed Barrett
informed the Committee there is a checklist that is used by the Planning Board
and Code that the developer must use. He stated if something is missed during
this process, when discovered, they can go back and enforce to make the
necessary correction. Jim Ring stated that field inspectors are not always able to
be at every project all the time but the inspectors try to correct when errors
occur. Counclor Palmer concurs it was a good idea to amend. Councilor
Blanchette suggested they needed to speak with the Planning Board to have
them become more aware of the Land Development Code before adding an
additional laws or adding amendment. She also referred to the Certificate of
Occupancy not being issued before inspected. Ed stated errors most often occur
between the Planning Board Approval process and the construction.
Councilor Palmer motioned for passage and it was seconded. There was a
unanimous vote.
Motion to adjourn made by Councilor Blanchette to adjourn meeting and
seconded.
