HomeMy WebLinkAbout2010-05-18 Infrastructure Committee Minutes Infrastructure Committee Tuesday, May 18, 2010 Minutes Councilors Attending: Patricia Blanchette, Harold Wheeler Staff Attending: Jim Ring, Dan Wellington, Ron Gastia, Paul Nicklas Others Attending: Committee convened at 5:00 p.m. 1. Easement Request: Maine Avenue Councilor Wheeler motioned, seconded by Councilor Blanchette with no discussion. 2. Easement Request: Texas Avenue Councilor Wheeler motioned, seconded by Councilor Blanchette with no discussion. 3. Easement Request: Harlow Street Councilor Wheeler motioned, seconded by Councilor Blanchette with no discussion. 4. Referral: Council Ordinance 10-178, Amending Chapter 271, Streets, of the Code of the City of Bangor, by Adding Street Discontinuances to Exemptions from Planning Board Hearing Requirements Jim Ring explained the State required notifications be made to the Planning Board of street discontinuances. When reviewing the Ordinance, it was noted discontinuances were not exempt. This action would make the Ordinance complete. Councilor Wheeler moved Staff recommendation and seconded by Councilor Blanchette for Council on Monday, May 24, 2010. 1 5. Referral: Council Ordinance 10-180, Amending Chapter 109 of the Code of Ordinances, Fees Dan Wellington explained the current fee schedule was implemented in 1992. When looking at the typical permit in relation to actual costs associated with who went out, how much time was spent. The proposed amendment would decrease impact on the general fund from Code and shift to the actual users of the services to include tax-exempt entities. Councilor Wheeler moved and Councilor Blanchette seconded for full Council. 6. Amending the Code of the City of Bangor by Adding Chapter 177 – Medical Marijuana Dispensary Paul noted the new Ordinance would provide security and oversight requirements for medical marijuana dispensaries and cultivation facilities that th were requested by the Committee on May 4. 7. Amending Land Development Code – Medical Marijuana Dispensaries Paul noted there would only be one dispensary allowed in either Penobscot or Piscataquis Counties and provided a map with the following outlined areas: Blue – Dispensaries would be allowed. Green – Cultivation facility would be allowed. Aqua – Both Dispensaries and Cultivation facility would be allowed. Councilor Wheeler referred to full Council with no recommendation as there were only two Councilors present. Councilor Blanchette asked if the 180 day moratorium would appear on May 24, 2010 Council Agenda and requested Paul Nicklas to explain, in full detail, on Monday night what work would need to be done during the moratorium. Paul noted the moratorium would only be in place until the Council enacted regulations and stated was prepared to speak to the Council on Monday. Ron was not comfortable with this as there needed to be more additions to the Ordinance and they needed to reach out to experts. He noted he would not be available for Monday’s meeting as he would be in Washington, D.C., Lt. Hathaway would attend in his stead. Councilor Wheeler withdrew previous motion and rephrased to refer it to June 14, 2010 Council and moved without recommendation. Councilor Blanchette withdrew second on original motion. Send to Council and back to IC on June 8, 2010. Paul mentioned the deadline for applicants for dispensaries needed to in to the th State by June 24. Ron noted that there was a provision for applicants with 2 regards to a proposed location but applicants would not be held to that particular proposed location. Councilor Wheeler held second motion. Councilor Wheeler noted he did not want it coming back to IC. Councilor Blanchette seconded both items. 8. Proposed Sign Ordinance Amendment – To Allow Directory Signs for Place of Worship There was random discussion. Councilor Wheeler motioned to adjourn, Councilor Wheeler seconded at approximately 5:49 p.m. 3
