1. Discontinuance: Former Private Way – Property on Mt. Hope Avenue
Art explained that he was approached by the owners of Rolling Meadows Subdivision, Hampden Home
Builders to extinguish the 16.5’ wide and 3,960’ long right-of-way easement situated on the easterly side of
the subdivision and just north of Severance Street. In 1891 the public easement was laid out as a private
right-of-way and in 1975 the Legislature converted all private ways laid out by the City Engineer into public
easements. This private way has been used for recreation vehicles and has never been constructed and
provides no benefit.
It was moved and seconded to move to the full Council.
Councilor Gratwick requested the location of the discontinuance, as the map in the packet was unclear. Art
explained that Mount Hope Avenue was to the bottom of the page, the actual discontinuance located to the
right of Rolling Meadows Subdivision, northerly of Severance. With abutters Beth Israel to the right and old
Harthorn property to the north end of the right-of-way.
Councilor Blanchette stated that she would prefer Councilor Gratwick to be comfortable with his vote and a
better map would be provided to the Council. Art expressed his apologies to the Committee that he was not
provided a better copy, as he requested before the meeting.
Councilor Gratwick stated he would vote against not on concept, but on specifics.
Councilor Weston asked if they would be extending the development. Art said no additional development
was expected, just extinguishing unused, un-built right-of-way.
Art explained, for the public and Councilor Weston’s clarity, this would go to Council on July 9, 2012. He
would conduct a public hearing, notice would be provided to the City Clerk, and he would provide an
Engineer’s report to the full Council upon completion of the public hearing.
Votes: Yes: Councilor Blanchette, Councilor Baldacci, Councilor Sprague
No: Councilor Gratwick
Motion made and seconded to adjourn at approximately 5:06 p.m.
