Responsible Department: Community& Economic Development ommentary: As part of a HUD Cruet awarded to the City in 1996 for the development of new building for ratenional housing for chronic substance abusing adults, Maine More Housing Authority (MSHA) will provide V2 of he cost ofconshtetion through Penstuis C.A.P, and the Federal Home Loin bank will provide a small subsidy. MSHA will need to secure their portion of the giant funds with a mortgage On the new facility (to be operated by Acadia Hospital Corp., formerly Hope House facility). In order for MSHA's mortgage as be secure on the building should Acadia Hospital default, the City and MSHA and Penqum C.A.P. must examine legal documents and will pmuctthe interests of each party on the leased premises. This Order would authorize the City Manager to execute all such documents as conjunction with the lease in order to protect the City's interest in the leased promises. The MSHA 'onofMID funding, and the Federal Home Loan Bank funding will expire on October 1, 1998. Al nils time, these ocuments are in then draft form. BY the City Coattail of the City ofHomm: TnT WHEREAS, by Comaid Older 98-328 the City Council of the City of Bangor approved a lease with Acadia Hospital Corp; and WHEREAS, the City of Bangor, Maim State Housing Authority, and the Federal Home Loan Bank will he passing through to Persian C.A.P. certain federal foods for the construction of a facility to be operzted by Acadia Hospital Corp. on land which is the subject of the lease approved by Council Order 98-328; and WHEREAS, the City of Bangor, Maine Stare Housing Authority, the Federal Home Loan Bank aod Penquis C.A. P. wish to take certain measures to provide for a replacement for Acadia Hospital Coop. in the event dot Acadia Hospital Corp. defaults on its obligations and ceases operation of the facility and to fwther agree upon rights and responsibilities in the event a replacement is not found. NOW, THEREFORE, BY THE CITY COUNCIL OF THE CITY OF BANGOR, BE IT ORDERED, THAT the City Manager is hereby authorised to execute agreemema between are City of Bangor, Mame Stam Housing Authority, Acadia Hospital Corp., the Federal Hove Loan Bank, and Pentiuls C.A. P. to pmvide our a replarzmem for Acadia Hospital Corp. in the event of such a default. The agreements are to be in a form approved by the City Solicitor or Assistant City Solicitor.
