Cermentary:
The proposed expansion of the Bangor East Little League fields on Forest Avenue may
impact approximately 0.88 acres of wetlands. The City may agree to preserve a
portion of its property in the Penjajawoc Stream watershed to mitigate the impact
of the proposed Little League project. This agreement would dedicate for
preservation up to 9.04 acres of City property in the Penjajawoc Stream watershed
to mitigate the impact of the Little League project.

THAT WHEREAS, the City of Ranges is the tt r r of land located in the Penjajawoc
Stream Watershed; and
WHEREAS, a portion of said land is wetlands; and
WHEREAS, Bangor Bast Little League is contemplating future expansion of its
facility located on Forest Avenue Extension, Bangor, Maine; and
WHEREAS, said expansion may require wetlands mitigation by Bangor Fast Little
League; ata
WHEREAS, Bangor East Little League wishes to be able to acquire wetlands in Ne
Penjajawoc Stream Watershed should such wetlands be required for mitigation purposes;
NOW, THEREFORE, BY THE CITY COUNCIL OF THE CITY OF BANGOR,
BE IT ORDERED,
THAT the City Manager is hereby authorized to execute an agreement between the City
of Bangor and Banger East Little League in a form substantially as attached herein, and as
approved as to form by the City Solicitor or Assistant City Solicitor.

AGREEMENT
Agreement made this_ day of , 1998 between CITY OF BANGOR,a
body corporate, of 73 Harlow Street, Bangor, Penobscot County, Maine thereinafter "the
City'%ard Hangar Fast Little League, a corporation duly organized and existing order the
laws of the State of Maine, having a principal place in Bangor, Petwbscot County, Maim
(hereinafter "the Little League').
WITNESSTH
WHEREAS, the City of Bangor is the owner of certain lots or parcels of land
located in the Penjajawoc Stream wetemhal, Bangor, Maine, said lots or parcels of land
being wetlands; and
WHEREAS, the Little League is contemplating future expansion of its facility
located on Forest Avarua, Baugoq Maine; and
WHEREAS, said expansion may, require wetland mitigation;
NOW THEREFORE, for consideration paid by the Little League to the City and
in consideration of me covenants and agreements hereinafter set forth, the parties lento,
for themselves and then successors and assigns, agree as follows:
1. The City does hereby agree to place a portion of the lot or parcel of land, not to
exceed 7.04 acres ander declaration of covenants and restrictions in the event that me
Little League expands its facility located on Forest Avenue and is required to do wetlands
mitigation as a condition of said expansion.
2. The Little Leagae agrees to take all &cps necessary, m minimize its need for
wetland mitigation.
3. The Little League shall give written notice of its intent to expand its facility
located on Forest Avenue w the City by May 1, 1999. Such notice shall be effective if
delivered to the City Manager's office at the City's address stated above.
4. The Little League shall start said expansion an later than September 1,1999
and complete it no later than September 1, 2001.
5. The Little League shall provide the City with a metes and bounds description,
subject to the approval of the City, of the wetlands to be used for mitigation.
