Commentary:
This Order would authorize an agreement with Lloyd and Elizabeth Harrison providing
for the demolition and clearance of property owned by them at 115 Forest Avenue, o
the c of Forest Avenue and Garland Street. Under the terms of the Agreement,
the City would demolish and clear this property that has deteriorated to the point
that it would not be feasible to attempt to rehabilitate it. The Harrison's would
have one year after the property is demolished and cleared from the site to sell the
vacant land. If they are
unable to sell the land in a year, the property would be
conveyed to the City fordisposition.
The cost of demolition is included in this years federally funded Community
Development Block Grant fund.

ORDEMD,
TMT the City Matager is hereby authonzed to miter into an Agreement with Lloyd and
Elizabeth Harrison providing for the demolition atd clearance of 115 Forest Avenue, a copy of
which is attached hereto, and a a final form approved by the City Solicitor or Assistant City
Solicitor.

AGREEMENT
AGREEMENT made this 26th day of August, 1998 by and between the CITY OF
BANGOR and LLOYD and ELIZABETH HARRISON, of 136 EM Sued, Bangor,
Maine.
WITNESSTH
WHEREAS, Lloyd and Elizabeth Harrison are owners of a certain lot or parcel of
land, together with a building thereon, located at 115 Forest Street, Baagor, Maine; and
WHEREAS, said building is in a condition w as to be a safety hamrd and is a
dangerous structure; and
WHEREAS, Lloyd and Elizabeth Harrison are without me financial means to
demolish said building; and
WHEREAS, Lloyd mud Elisabeth Harrison are willing to cooperate with the City
of Bangor in the demolition of said building without requiring the City of Bangor to have
condemnation proceedings; end
WHEREAS, Ne cooperation of Lloyd and EI'vabelh Harrison will save the City of
Bangor time and money and result in the removal of dangerous in amore timely manner
than might otherwise Wpm N the event ofcondemnation proceedings.
NOW THEREFORE, the City of Bangor and Lloyd end Elizabeth Renison agreed
as follows:
1. The City of Bangor will demolish me building belonging to Lloyd and
Elizabeth Harrison Incurred at 115 Forest Avenue, Damon, Maine and remove the debris
from said demolition.
2. Said demolition and removal of debris will be dome at no cost to Lloyd end
Elizabeth Benison,
3. Lloyd and Elizabeth Harrison will immediately thereafter after the land at 115
Forest Avenue for sale. In the event the land is not sold for fah market value within one
year of the date that it is fust offered for sale, then Lloyd and Elizabmh Hanson will
convey the lend to erre City of Bangor by quitclaim deed with covenant. The
consideration for said conveyance to the City of Bogor shell be the terms and conditions
of this Agreement.
4. Lloyd and Elizabeth Harrison will not encumber said property in my manner.
5. The City of Bangor shall do an enviroruuental survey of the property and, in the
sole discretion of the City of Bangor, based upon the results of said survey, the City of
Bangor may void this agreement and any responsibilifies theremula.
6. Lloyd and Elizabeth Harrison bereby waive any claim against the City of
Bangor that they may have as aresult of the City of Bangor's demolition of said building.
IN WITNESS WHEREOF, the patties have executed this Agreement as of the
daze fust written above.
