Applicant is requesting a contract zone change from Neighborhood
Service District and Urban Residence 2 District to Contract Urban
Service District for the property located at 180 Center Street
(Manna).
This request is the same Contract Zone Change request that was
approved by the City Council at its meeting of March 23, 1998.
However, because the Contract Zoning Agreement was not executed
nor recorded in the Penobscot County Registry prior to the 90 day
expiration date contained in that approved Council Ordinance,
that approval lapsed. 'Therefore, the applicant is seeking re -
approval,

THAT the zoning boundary lines as established by the Zoning map
rl_ the City of Bangor dated October 28, 1991, as amended, be
hereby further amended as follows:
By changing a parcel of land located at 180 Center Street (Tax
Map No. 39, Lot 181 and a portion of Lot 183) from Neigbborbood
Service District and Urban Residence 2 District to Contract Urban
Service District. Said parcel containing approximately 13,780
square feet and being more particularly indicated on the map
attached hereto and made a part hereof.
PROVIDED, HOWEVER THAT, in addition to the mandatory conditions
imposed by Chapter VIII, Article 2, Section 6.6 of the Ordinances
of the City of Bangor, said change of zone is granted subject to
the following conditions:
1. The use and/or operation of the subject premises shall
be subject to the following limitations and/or restrictions:
A. No alcoholic beverages shall be served or consumed on
the premises.
B. The gross floor area of the building shall not exceed
2,000 square feet.
C. No activity on the site shall be open to the public
between the hours of 1:00 a.m. and 6:00 a.m.
D. No gaming machines shall be operated or located on the
premises.
2. Execution by those parties with an interest in the
affected property of an agreement providing for the
implementation and enforcement of all the terms and conditions
Set forth above and the recording of said executed agreement in
the Penobscot County Registry of Deeds by the property owner, a
copy of said agreement being on file in the office of the City
Clerk and incorporated herein by reference. In the event that
said agreement is not so executed within ninety (90) days from
the date of passage hereof, this Ordinance shall became null and
void.
