By Council Order #97-309 passed by the City Council on July 14,
1997, the Finance Director was authorised to execute a municipal
quitclaim deed releasing the City's interest in real estate located
at 36 Blue Hill West owned by Bruce and Roseanne Burke by virtue of
matured sewer and real estate tax liens. At the time of payment of
the liens, the bank had requested that title revert back to the
Burkea. The Finance Committee recommended approval at its July 20,
1997 meeting.
The deed authorized under previous Council action was never
recorded at the Registry of Deeds. Since last July, the bank has
foreclosed against the Burkes and has now requested that the deed
be directed to it so that they may sell the property. Apparently,
a closing is scheduled in the near future.

THAT Ronald 1. Heller, Finance Director, is hereby
authorized, on behalf of the City of Bangor, to execute a Municipal
Quitclaim Deed releasing any interest the City may have in the real
estate located at 36 Blue Hill West in said Bangor by virtue of
matured municipal sewer charge and real estate tax liens recorded
in the Penobscot County Registry of Deeds in Book 5847, Page 138
and Book 5874, Page 339. Said deed shall be directed to The Hank
of New York, successor in interest to Bruce A. Burke and Roseanne
B. Burke.

The CITY OF BANGOR, a body corporate, located in Bangor,
Penobscot County, Maine, for consideration paid, releases to THE
BANK OF NEW YORK, as Trustee under the Pooling and Servicing
Agreement dated as of May 31, 1994, Series 1994-8, as Grantee,
successor in title to Bruce A. Burke and Roseanne B. Burke, a
corporation organized and existing under the laws of the State of
New York, and having its principal place of business in the City of
New York and State of New York, a certain lot or parcel of land
together with any improvements thereon, situated in Bangor,
Penobscot County, Maine, more particularly described as follows:
"Being Lot N4 according to a plan of land
entitled "Final Subdivision Plan of Pinewood
Estates for Land Investment, Inc., Ohio Street E
Blue Hill West, Bangor, Penobscot County, Maine"
prepared by Andrew J. Shyka and dated March,
1999, and recorded in the Penobscot County
Registry Of Deeds in Map File D47-09.
Being the same premises as described in a
Warranty Deed from William L. Munson and
Lorraine L. Munson to Bruce A. Burke and
Roseanne B. Burke, dated September 22, 1988 and
recorded in Book 4317, Page 347, Penobscot
Registry of Deeds.
Any and all other rights, easements, privileges
and appurtenances belonging to the granted
estate are hereby conveyed.
The purpose of this deed is to release to the Grantees any
interest the Grantor may have in the above described property by
virtue of sewer liens recorded in Book 5840, Page 138 and Book
5958, Page 202 and a real estate tax lien recorded in Book 5874,
Page 339, Penobscot Registry of Deeds. All public easements or
other public interests in the described premises for roads,
utilities, or other public purposes are expressly reserved.
The said CITY OF BANGOR has caused this instrument to be
sealed with its corporate seal, and signed in its corporate name by
RONALD 1. HELLER, Finance Director, thereunto duly authorized,
this day of August, 1998.
