Item/Subject: Authorizing Execution of Municipal Quitclaim Deed

Sewer liens on property located at 60-62 Ohio Street assessed
against former property owner Rachel S. Berce were recorded in
November, 1994 and May & September, 1995. Earlier this month
payment was received in the amount of $11,100 for outstanding sewer
charges. Payment was
made by the current property owner, CEI
Housing. Inc., undera workout agreement previously approved by the
Finance Committee On dune 1st. Because the Hewer liens have
matured, this Order would authorize release of the City's interest
in the property back to CEI Housing, Inc. There are no existing
code violations with the property, and the real estate tax account
is current.
The Finance Committee recommended approval at its meeting held on
July 6th.

ORDERED,
T9nT Ronald I. Heller, Finance Director, is hereby
authorized, on behalf of the City of Bangor, to execute a Municipal
Quitclaim Deed releasing any interest the City may have in the real
estate located at 60-62 Ohio Street in said Bangor by virtue of
matured municipal sewer charge liens recorded in Book 5752, Page
324; Book 5847, Page 130; and Book 5958, Page 287 in the Penobscot
Registry of Deeds. Said deed shall be directed to CEI Housing,
Inc., successor in title to Rachel S. Berea.

The CITY OF BANGOR, a municipal Corporation located
in
Bangor, Penobscot County, Maine, as Grantor, for consideration
paid, releases t0 CEI HOUSING, INC., Of WisCas6Set, Lincoln
County,
Maine, as Grantee, successor in interest to Rachel S. Beres,
the
land and buildings thereon, situated in Bangor, County of
Penobscot, State of Maine, described as follows:
PARCEL ONE: Beginning in the westerly line of
Ohio Street at the northeast corner of lot
conveyed to Daniel Lunt by Taylor Durgin by deed
dated September 4, 1874, recorded in the
Penobscot Registry of Deeds, Book 446, Page 453;
thence southeasterly by said street thirty-three
(33) feet, three (3) inches, or about that, to a
Point directly in front Of the partition between
the two tenements of the house as it meets the
front wall of the house by the front door:
thence southwesterly to the middle point of said
partition, and thence in same direction along
Middle line of said partition a few feet to the
angle; thence continuing same course ninety (90)
feet from the street to a point in the line next
described; thence northwesterly parallel with
said street thirty-three (33) feet, three (3)
inches, or about that, to a stone monument
standing in the northerly line of lot described
n said Durgin deed, and Passing over another
stone monument twenty-four (24) feet south-
easterly of that; thence northeasterly by the
line of said lot ninety (90) feet to the point
begun at.
PARCEL TWO: The southerly tenement of the house
referred to and the land on which is stands,
conveyed by said Durgin to Lunt, beginning at
the easterly corner of the westerly line of Ohio
Street of the parcel first described; thence
southeasterly along the line of Ohio Street
fifty-three and nine twelfths (53 9/12) feet,
thence at right angles to the line of Ohio
Street southwesterly one hundred (100) feet more
or less to a bolt (to be placed), thence at
right angles northwesterly and parallel to the
line of Ohio Street sixty-three (63) feet to a
bolt (to be placed), thence at right angles
northeasterly ten (30) feet to a stone monument,
thence at right angles southeasterly along the
southwesterly line of the parcel first described
nine and three -twelfths (9 3/12) feet to the
southeast corner of the first described parcel,
thence at right angles northeasterly along the
southeasterly line of said parcel first
described ninety (90) feet to the point of
beginning.
Excepting nevertheless, a right of way for
vehicles and pedestrians extending along the

southeasterly side of said parcel secondly
described, said right of way having a width of
ten (10) feet, from the line of Ohio Street to
land and buildings thereon being the rear part
of the second Parcel described in said deed of
Durgin toLunt, said right of way to be used in
This conveyance is subject to an easement for
the use of water and sewerage pipes that cross
the above described lot and service the building
in the rear of this lot.
Being the same premises described in a Warranty
Deed frau Brent M. Trueworthy and Suzanne M.
Trueworthy t0 Rachel S. Berce, dated August 22,
1991 and recorded in Book 4896, Page 255,
Penobscot Registry Of Deeds. Said property 1s
designated further in City records as Tax Map
33, Lot 54A, real estate account number 21379.
Any and all other rights, easements, privileges
and appurtenances belonging to the granted
estate are hereby conveyed.
The purpose of this deed is to release to the Grantee any
Interest the Grantor may have in the above-described property by
virtue of matured sewer liens assessed against Rachel S. Berce
recorded in Book 5752, Page 324; Book 5847, Page 130; and Book
5958, Page 287, Penobscot Registry of Deeds. All public easements
or other public interests in the described promisee for roads,
sewers, or other purposes are expressly reserved.
The said CITY OF BANGOR has caused this instrument t0 be
sealed with its corporate seal, and signed in its corporate name by
RONALD I. HELLER, Finance Director, thereunto duly authorized,
