This item authorizing sale of Lot 9 in BarAiI Industrial Park to Black Bear
Couriers, Inc. for development of a package sorting and ground distribution
facility has been reviewed and recommended for approval by the Board of Directors
of the BanAir Corporation. Me offer by Black Bear Couriers, Inc, to purchase
and develop Lot 9 will also be reviewed the Community and Economic Development
Committee at its meeting on April 8 with arendation by the staff that it be
approved with the conditions recommended by the Board of Directors of the BanAir
Corporation (see attached Meat).

WHEREAS, Black Bear Couriers, Inc. has offered to purchase Lm 9 in Ballir
Industrial Park with an Area of approximately 1.7 acres:
NOW THEREFORE BE IT ORDERED BY THE CITY COUNCIL OF THE CITY
OF BANOOR THAT the City Manager is hereby authorvN, on behalf of the City
of Bangor, to execute a purchase and sale agreement with Black Bear Couriers,
Inc, for dre sale of Lot 9 in BaMir Industrial Perk, in aform approved by the City
Solicitor or Assistant City Solicitor, and subject to such conditions as may be
approved by the Community and Economic Development Committee of the City
Council.

Subject: Sale of 1.7 acres in the BanAir Industrial Park to Black Bear Couriers, Inc.
Issue
Black Bear Couriers, Inc., has made an offer to purchase Lot 9 in the BanAir Industrial
Park on Outer Hammond St. for $40,900.
Black Bear Couriers, Inc., owned by Daniel Clark and Blair Lovejoy, wish to construct a
8,344 sq. ft. building on lot 9 for use as small package sorting and ground distrbution
facility, garage and dispatch office. Black Bear Couriers, Inc. is a local courier company
that currently has a contract with Airborne Express to provide all overnight delivery of
packages in Eastern and Northern Maine. Black Bear Couriers, Inc. also operates a
small courier service for same-day delivery of medical laboratory packages. The
company currently has 27 employees.
The offer of $40,900 is the same as the asking price and is made contingent upon:
1. Approval of a ske plan by the Bangor Planning Board
2. Approval of financing for the complete project.

Lot 9 is 1.7 acres with frontage on Brm it Rd. The proposed project would be a
moderately sized development on the lot. However, after analyzing the proposed
structure and the necessary access and loading areas, a lot of this size is necessary for
the development.
The City of Bangor is not represented by areal estate agent in this matter.
Recommendation
The Board of Directors of the BanAlr Corporation and staff recommend that the offer be
accepted with the fallowing terms and conditions:
a. Site work and building improvements shall commence within one (1) year.
Sufficient evidence of proceeding with the "building improvements" is an
approved Land Development Permit, issuance of a Building Construction
Permit and inflation of construction of the building.
b. Site work and building improvements shall be completed within two (2) years.
c. The building shall have a gross floor area of not less than 8,344 sq. ft.
d. The area within the front setback must be landscaped and planted with trees
and shrubs as follows: plant units per 100 ft.: one (1) shrub, one (1)
evergreen tree, and one (1) deciduous tree.
e. The sale is contingent upon approval of a site plan by the Bangor Planning
Book.
f. The sale is contingent upon the purchasers receipt of financing for the
complete project.
