HomeMy WebLinkAbout1998-04-13 98-170 ORDINANCEDate April 13 1998 Item No. 98-170 Item/Subject: Amending Land Development Code - 1039 Union Street Responsible Department: Planning Division For Referral to Planning Board Meeting Of April 21, 1998 at G:OD p.m. This is a reapplication for a contract zone change from Shopping and Personal Service District t0 Contract Downtown Development District for a parcel Of land approximately 41,998 square feet being located behind 1039 Union Street (Concord Trailways facility). The City Council previously approved this contract zone change on November 10, 1991 when it approved C.O. A 97-434 (As Amended). As the contract zoning agreement was not executed and recorded in the Penobscot Registry Of Deeds prior to the 90 day expiration date contained in that Ordinance, the approval lapsed. The applicant is now asking for reapproval. THAT the oning oundary lines ae established by the Zoning map of the City of Bangor dated October 28, 1991, as amended, be hereby further amended as follows: By changing a part of a parcel of land located behind 1039 Union Street (Tax map No. R-24, Part of Lot 17) from Shopping and Personal service District to Contract Downtown Development District. Said parcel containing approximately 41,998 square feet and being more particularly indicated on the map attached hereto and made a part hereof. PROVIDED, HOWEVER THAT, in addition to the mandatory conditions imposed by Chapter VIII, Article 2, Section 6.6 of the Ordinances of the City of Bangor, said change of zone is granted subject to the following conditions: 1. The use and/or Operation of the subject premises shall be subject to the following limitations and/or restrictions: A. Use shall be limited to accessory use parking for existing bus terminal located on adjoining land at 1039 Union Street, Bangor, Maine. B. The parcel shall be developed in accordance with the development standards for the Shopping and Personal Service District as set forth in the Land Development Code of the City of Bangor, Maine, in effect on November 4, 1997. 2. Execution by those parties with aninterest in the affected property of an agreement providing for the implementation and enforcement of all the terms and conditions set forth above and the recording of said executed agreement in the Penobscot County Registry Of Deeds by the property owner, a copy of said agreement being on file in the office of the City Clerk and incorporated herein by reference. In the event that said agreement is not so executed within ninety (90) days from the date of passage hereof, this Ordinance shall become null and void.
