Shannon -- Land on Kittredge Road (Map R67, Lot 6) Responsible Department: Legal Commentary: In December 1997 the Finance Committee directed City staff to pursue the possibility of acquiring the so-called Shannon lot which abuts the City Forest. Marvel Shannon held a 2/3 interest in the property, with the remaining 1/3 interest held by Ralph Shannon. After negotiation, in late February 1998, the City and Mrs. Shannon agreed on a price of $18,000 for her interest provided that the deed contain a covenant to prevent the property from being developed. On March 26th, a closing was held and the deed has since been recorded. This Resolve would ratify the actions of City staff in finalizing the acquisition of this property. Shannon for her 2/3 interest in approximately 62 acres of land abutting the City Forest are hereby ratified and confirmed. A copy of the deed in its executed form is attached to this Resolve. SHANNON, of Bangor, Penobscot County, Maine, as Grantor, for consideration paid, grants to the CITY OF BANGOR, a municipal corporation organized and existing under and by virtue of the laws of the State of Maine, WITH QUITCLAIM COVENANTS, land located at Bangor, Penobscot County, Maine, as Grantee, the following described real estate, as follows: A two-thirds interest in and to a certain lot or parcel of land situate in Bangor, Penobscot County, Maine, and adioinina the town line of Orono, being lot numbered fifteen according to Hussey's plan and survey of Bangor, and being the same premises which were conveyed to John S. Chadwick by the Treasurer of the City of Bangor by deed dated September 15, 1873, and recorded n Penobscot Registry of Deeds, Book 459, Page 142, and being also the same premises conveyed to Calvin Kirk by Sarah C. Chadwick, adminis- tratrix of the estate of John S. Chadwick by her deed dated August 19, 1888 and recorded in Penobscot Registry of Deeds Vol. 516, Page 98, to which deed reference is to be had for a more particular description of the premises herein conveyed. Said lot containing sixty-two acres, more or less. Said property is designated further in City records as Assessor's Map R67, Lot 6, real estate account number no. 59354. Being the same premises described in a Deed of Sale by Personal Representative (Testate) from Ralph J. Shannon, duly appointed and acting Personal Representative of the Estate of Stanley B. Shannon, aka Stanley E. Shannon, Sr. to Christina M. Hasenfus and Ralph J. Shannon. dated February 10, 1994, and recorded in Book 5635, Page 283, Penobscot County Registry of Deeds. Grantee, for itself and its assigns, does hereby covenant, grant, promise and agree to and with the said Grantor that, for a period of fifty (50) years from the date of this deed, no commercial or residential building shall be erected upon the land hereby conveyed. Any and all other rights, easements, privileges and appurtenances belonging to the granted estate are hereby conveyed. WITNESS my hand and seal this Z day of March, 1998.
