Commentary;
At its February 12 meeting, the Historic preservation Commission (HPC) considered
a request by the Community & Economic Development Department seeking contingent
approval to demolish the filter house (the building closest to and parallel to State
Street) and the Engineer's House and garage (the wood frame house and garage) at the
Bangor Waterworks. Although the City has no redevelopment proposal before it at this
time, it is anticipated that the demolition and removal of one or
more
of these
buildings would be necessary to provide adequate parking to support reuse of the
perifinder of the property. The City's request w intended to start the 180 -delay"
od required by the Historic Preservation Ordinances for the demolition and
removal of buildings on a designated historic site. The HPC denied the application
on the filter house and amended the request for demolition of the Engineer's house
and garage to ing- the Engineer's House (instead Of demolition) and demolition
of the garage, subject to the issuance of a Certificate of Appropriateness at the
end of the 1BP `delay- period. The Centificate of Appropriateness would be issued
if the City has taken all the required actions to attempt to find a party that would
purchase and restore the buildings and land involved, and failed to find such a
party. If a party comer forward that is willing to purchase and restore the
Engineer's House and garage on site, it is assumed the City would not be able to
remove the Engineer's House and demolish the garage. This procedure does not assure
permission to remove the buildings at the end of the six-month delay period, but does
authorize the actions listed in the Order which are required to "start the clock'
on the six-month delay provision of the Ordinance

ORDERED,
THAT WH EREAS the Bangor Historic Preservation Commission has approved a Certificate
of Appropriomess for the removal of the Engineer's House and me demolition of the
adjacent detached wood framed garage; and
WHEREAS order the provisions ofthe Historic Preservation Ordinance a certificate for
movement or demolition shall be delayed f« a period of 180 days during which time the
City as owner is required to take certain actions;
NOW THEREFORE, BY THE CITY COUNCIL OF THE CITY OF BANGOR BE IT ORDERED
THAT the Director of Community and Economic Development is authorized to take the following
actions:
1. For a period of not less thea six months, more a bona fide offer in sell the Engineer's House
and adjacent wood frame garege, and the hand perming thereto, at a pnce reasonably returned
to its face market value, as approved by the Community and Economic Development
Committee, to any person, firm, corporation, government or agency thereof, or political
subdivision or agency thereof, which gives reasonable assurance that it is willing to preserve
and restore the building or structure and the land pertaining thereto.
2. Prior to making such offer to sell, file a statement with the Historic Preservation Commission,
identifying but property, For offering price and me date the offer to sell shag begin.
3. Post rwtices on the premises of the building or structure proposed for demolition and removal

4. Publish notices m a newspaper of general local circulation at least three (3) times prior to
demolition, the final notice of which shall be not less than fifteen IF 5) days prior to the date
of the permit, and the first notice of which shall be published no more am fifteen (15) days
after the application for apemtit, to demolish or remove, is filed.
S. If, prior tothe issuance of a cestifirate for removal, there have been no bona fide aff made
to the City, and if no contract for sale has been executed with interested parties by the City,
stipulate that the proper notice as required had been posted, that the property was properly
offered for sale, that there have been no bomm fide offers made, and then no contract for sale
has been executed with interested parties.

RE: Notice of Decision, Bangor Historic Preservation Commission, Property Located at
635 State Street
This is to notify you that at the February 12, 1998 meeting, the Commission considered the
Certificate of Appropriateness request to demolish Engineer's House and garage at the above
referenced location.
Approval is subject to the following conditions:
1. The application "a amended to moving the engineer's house and demolishing the
garage. The CeNgcate of Appropriateness will be granted at to expiration of the 180
day period provided all posting requirements have been met.
This deasion, all supporting documents and a tape recording of the meeting will remain on file in
the Code Enforcement Office.
All appeals from decisions of the Commission are to the Board of Appeals, pursuant to Chapter
VII, Article 4, Section 10.5 of the City Ordinance.
